The Judicial Appointments Commission held its monthly meeting No. 3/2012 at the Ipoh Court Complex, Perak on 15 Mac 2012. The Commissioners visited several sections of the court such as the Registry of the Sessions / Magistrates Court and the Registry of the High Court. The aim of the visit was to look at the various ways undertaken by the courts in Ipoh to improve its delivery system.
EVALUATION CRITERIA FOR THE APPOINTMENT OF SUPERIOR COURT JUDGES
1. These recommended Evaluation Criteria are grounded on the consideration that the public interest in improving the quality of our judicial system is best served by merit selection of judges and judicial commissioners.
2. The criteria are designed to ensure that nominees have the intellectual capacity, the efficiency and personal qualities which would enable them to resolve disputes impartially and decide solely upon the facts of the cases and the law. These criteria need to be rigorous, both in their articulation as well as in their application in the selection process.
This code is intended to set basic standards to control the conduct of all judges and the guidance to judges in establishing and maintaining character and conduct of the higher judiciary.
The Federal Constitution of Malaysia, which came into force in 1957, is the supreme law of Malaysia. The Constitution establishes the Federation as a constitutional monarchy having the Yang di-Pertuan Agong as the Head of State whose roles are largely ceremonial. It provides for the establishment and the organization of three main branches of the government: the bicameral legislative branch called the Parliament, which consists of the House of Representatives (in Malay, Dewan Rakyat) and the Senate (Dewan Negara); the executive branch led by the Prime Minister and his Cabinet Ministers; and the judicial branch headed by the Federal Court.
