  • Induction Programme for Judicial Commissioner, 15 - 22 December 2015

    An introductory course entitled “Induction Programme for Judicial Commissioner” has been held from 15 to 22 December 2015 in The Secretary’s Office, Judicial Appointments Commission, Palace of Justice, Putrajaya. The course’s primary objective is to prepare and enlighten the newly appointed Judicial Commissioners (JCs) on their duties, responsibilities and best practices.

    A total of 10 newly appointed JCs attended the course, and a total of 12 papers have been presented by a panel of speakers consisting of Senior Judges, namely the Federal Court Judges, Court of Appeal Judges and High Court Judges. The papers presented are Judge Craft, Case Management, Conducting Trial and Hearing, Capital Offences, How to Read Statute, Practical Approach to Judgment Writing, Family Law, Mediation, Land Acquisition, Civil Procedure: Salient Features of the Rules of Court 2012, High Court Special Powers and Salary, Allowances and Benefits for Judges.

    “Induction Programme for Judicial Commissioners” was held on 25th-28th November 2019 (Monday-Thursday) at the Secretary’s Office, Judicial Appointments Commission, Palace of Justice, Putrajaya. The objective of this programme is to expose the participants the scope and areas of work and best practices that must be followed when fulfilling their duties and responsibilities as Judicial Commissioners.

    This course was conducted in the form of lectures with a total of 16 topics presented by senior judges namely “Practical Approach to Judgment Writing and Importance of Language”; “Salient Features of the Rules of Court 2012”; “When to Recuse”; “Committal Proceedings”; “Adjudicating Cases and Reduction of Charges under Section 302 of the Penal Code”; “Dealings with Conflict and Unexpected Contentious Situations”; “Case Management in Civil and Criminal Cases”; “Adjudicating Cases under Security Offences (Special Measures) Act 2012 (SOSMA)”; “Assessing the Credibility and Reliability of Evidence”; “Criminal Law: Evidence and Procedure”; “Judge Craft”; “E-Court System and Practical”; “Adjudicating Trafficking of Drugs Cases under Section 39B of the Dangerous Drugs Act 1952”; “How to Read Statutes”; “Business of Judging: Practical Workshop”; dan “Salary, Allowance and Benefits for Judges”.

    A total of 15 candidates to be appointed as Judicial Commissioners have attended this course, namely YBhg. Datuk Haji Aslam bin Zainuddin, YBhg. Dato’ Norsharidah binti Awang, YBhg. The objective of this programme is to expose the participants the scope and areas of work and best practices that must be followed when fulfilling their duties and responsibilities as Judicial Commissioners.

    This course was conducted in the form of lectures with a total of 17 topics presented by senior judges namely “The Making of a Good Judge”; “Judge Craft”; “Dealings with Conflict and Unexpected Contentious Situations”; “When to Recuse”; “Business of Judging: Practical Workshop”; “Salient Features of the Rules of Court 2012”; “Case Management”; “An Overview to Court-Annexed Mediation”; “Practical Approach to Judgment Writing and Importance of Language”; “How to Read Statute”; E-Court System and Practical”; “Criminal Law: Evidence and Procedure”; Adjudicating Trafficking of Drugs Cases under Section 39B of the Dangerous Drugs Act 1952”; “Adjudicating Cases under Section 302 of the Penal Code”; “Adjudicating Cases under Security Offences (Special Measures) Act 2012 (SOSMA)”; “Assessing the Credibility and Reliability of Evidence”; and “Salary, Allowance and Benefits for Judges”.

  • Induction Programme for Judicial Commissioners 29th March-1st April 2021

    "Induction Programme for Judicial Commissioners" was held on 29th March-1st April 2021 (Monday-Thursday) at the Secretary's Office, Judicial Appointments Commission, Palace of Justice, Putrajaya. This programme aimed to expose the participants to the scope and areas of work and best practices that must be adhered to when fulfilling their duties and responsibilities as Judicial Commissioners. This programme was the first activity organized by the Judicial Academy in 2021 during the Recovery Movement Control Order (RMCO) due to the COVID-19 pandemic.

    A total of 10 candidates of Judicial Commissioners attended this course, including Puan Amelati Anak Parnell, Puan Norliza binti Othman, Tuan Hasbullah bin Adam, YBhg. Dato' Sri Shamsulbahri bin Haji Ibrahim, Tuan Roslan bin Mat Nor, Puan Julia Binti Ibrahim, YBhg. Datuk Mohamad Abazafree bin Mohd Abbas, YBhg. Dato' Mohd Arief Emran bin Arifin, YBrs. Dr. John Lee Kien How@Mohd Johan Lee, dan Puan Adlin binti Abdul Majid.

    The course began with a speech delivered by The Right Honourable Tun Tengku Maimun Binti Tuan Mat, Chief Justice of Malaysia, followed by a course briefing by The Honourable Datuk Seri Haji Mohd Zawawi bin Salleh, the Federal Court Judge and the Chairman of the Training Committee, Malaysian Judicial Academy. This four-day course was conducted in lectures and was followed by a question and answer session. A total of 10 topics were presented by senior judges entitled "Joint Session with Chief Judge of Malaya and Chief Judge of Sabah and Sarawak"; "Salient Features of the Rules of Court 2012"; "Judgement Writing Workshop"; "Case Management in Civil Cases and Court-Annexed Mediation"; "How to Conduct Criminal Trials and Appeals/Revisions in the High Court"; "Managing Procrastination and Competing Priorities"; "When to Recuse"; "Contempt Proceedings"; "How to Read Statutes"; dan "Judicial Power Under the Federal Constitution". Lectures entitled "e-Court System and e-Review"; and "Salary, Allowance and Benefits for Judges" were presented by officers from the Office of the General Registrar of the Federal Court of Malaysia. The Right Honourable Tun Tengku Maimun Binti Tuan Mat, Chief Justice of Malaysia, had presented certificates to the participants who will be appointed as Judicial Commissioner at the end of the course.

    A course entitled “Induction Programme for Judicial Commissioners” was held from 13 - 14 April 2015 at the Palace of Justice, Putrajaya.

    A total of 5 newly appointed Judicial Commissioners attended this course The Hon. Dr. Haji Alwi bin Haji Abdul Wahab, The Hon. Tuan Ahmad bin Bache, The Hon. Dato’ Mohd Firuz bin Jaffril, The Hon. Tuan Mohd Nazlan bin Mohd Ghazali and The Hon. Tuan Gabriel Gumis Humen.

    Senior judges presented 6 papers as follows:

  • Induction Programme For Judicial Commissioners, 20-27 March 2017

    The Course "Induction Program for Judicial Commissioners" were held 20-27 March 2017 at the Office of the Secretary of the Judicial Appointments Commission, Palace of Justice, Putrajaya. This course aims to expose the new Judicial Commissioners appointed on the job scope and best practices to be followed in carrying out its duties and responsibilities.

    A total of 14 Judicial Commissioners have followed this course. A total of 19 topics were be delivered by senior judges consisted of the President of the Court of Appeal, Chief Judge of The High Court in Malaya, Federal Court Judge and Judge of the Court of Appeal.

    Among the topics of the lectures are Judge Craft: The Making of a Good Judge, Pending Hearing and Sitting in Judgment; Case Management; How to Read Statute; Judgment Writing: The Important of Language; Practical Approach to Judgment Writing; Dealing with Conflict and Unexpected Contentious Situation; When to Recuse; Assessing the Credibility and Reliability of Evidence; Adjudicating Trafficking of Drug Cases Under Section 39B of the Dangerous Drugs Act 1952; Adjudicating Cases Under Section 302 of the Penal Code; Criminal Law: Evidence and Procedure; An Overview to Court-Annexed Mediation; Salient Features of the Rules of Court 2012; e-Court System; and Salary, Allowances and Benefits for Judges.

    “Induction Programme for Judicial Commissioners” was held on 6th-9th July 2020 (Monday-Thursday) at the Conference Hall, Palace of Justice, Putrajaya. The objective of this programme was to expose the participants on the scope and areas of work and best practices that must be adhered when fulfilling their duties and responsibilities as Judicial Commissioners. This programme was the first activity organized by the Judicial Academy in the new norm of the Recovery Movement Control Order (RMCO) due to the COVID-19 pandemic.

Lectures entitled "e-Court System and e-Review", and "Salaries, Allowances and Benefits of Judges" were presented by officers from the Office of the Chief Registrar, Federal Court of Malaysia. The Right Honourable Tun Tengku Maimun binti Tuan Mat, Chief Justice of Malaysia, had presented certificates to the participants after the course ended.

    Kursus “Injunctions” telah diadakan di Banglo Transit, Presint 10, Putrajaya pada 14-15 April 2012 (Sabtu dan Ahad).

  • Insolvency Act 1967: Understanding The New Bankruptcy Law, 10 February 2018

    The Seminar of “Insolvency Act 1967: Understanding the New Bankruptcy Law” was held on 10 February 2018 (Saturday) at the Conference Hall, Palace of Justice, Putrajaya. The objective of this seminar is to provide an overview of the amendments to the Bankruptcy Act 1967, now renamed the Insolvency Act 1967.

    A total of 111 participants consisting 7 Federal Court Judges, 18 Court of Appeal Judges, 33 High Court Judges, 20 Judicial Commissioners, 30 Judicial and Legal Officers, and 3 invited staff from the Counseling and Credit Management Agency (AKPK) were attended the seminar. The seminar was also attended by The Right Honourable Tun Raus Sharif, Chief Justice of Malaysia, The Right Honourable Tan Sri Dato’ Sri Ahmad bin Haji Maarop, Chief Judge of the High Court in Malaya and The Honourable Tan Sri Dato’ Sri Azahar bin Mohamed, Federal Court Judge as Chairman of the Judicial Academy.

    The First Session of the seminar was presented by YBhg. Datuk Meor Hashimi bin Abdul Hamid, Deputy Director General of Insolvency, Malaysia Department of Insolvency (MdI) on the title “An Overview of the New Bankruptcy Law”. In the Second Session, the talk was delivered by The Honourable Datuk Abdul Karim bin Abdul Jalil, Court of Appeal Judge on the title “New Rescue Mechanism: Voluntary Arrangement and Interim Order”. The talk titled “Specific Features of the New Insolvency Regime: Single Bankruptcy Order, Order of Substituted Service, Automatic Discharge” was delivered by The Honourable Datuk Hasnah binti Dato’ Mohammed Hashim, Court of Appeal Judge in the Third Session. While in the Fourth Session, The Honourable Datuk Vernon Ong Lam Kiat, Court of Appeal Judge has acted as moderator to conduct a question-and-answer session with panel members comprising speakers in the First, Second and Third Sessions.

  • Intellectual Property Law, 3rd-4th September 2016

    The Course "Intellectual Property Law" was held on 3 and 4 September 2016 (Saturday and Sunday) at Putrajaya. The course that was inaugurated by The Right Honourable Tan Sri Dato' Seri Zulkefli bin Ahmad Makinudin, Chief Judge of The High Court of Malaya is the sixth program organized by the Judicial Academy in 2016.

    Participants consist of:

    (i) High Court Judge - 8 participants; and
    (ii) Judicial Commissioner - 7 participants.

    While, the speakers/facilitators are made up of:

    (iii)  The Honourable Tan Sri Zaharah binti Ibrahim

    Title of talk: Overview

    The participants were divided into three groups to solve task of two case studies and afterwards to conduct presentations in this course. The case studies task is intend to provide a better understanding and improve problem-solving skills of the participants regarding on cases of "Intellectual Property Law" in Malaysia.

    Discussion and question and answer session was held after the presentation of each group.

    The course lasts for half a day which has been implemented smoothly and got a very positive evaluation among participants.

  • International Trademark Association’s Workshop

    The “International Trademark Association’s Workshop” Programme was held on 26th November 2021 (Friday) at the Banquet Hall, Palace of Justice, Putrajaya. The objective of this programme was to provide participants with a comprehensive understanding of the issues related to trademark law. This programme was the fifth under the Judicial Academy Malaysia in 2021 and the fourth to be conducted online using the Zoom Meeting application. The implementation of this online programme was to comply with the Standard Operating Procedures (SOP) to control the spread of the COVID-19 pandemic with all the speakers and participants who attended online.


    The half-day programme began with an opening address by The Right Honourable Tun Tengku Maimun Binti Tuan Mat, Chief Justice of Federal Court, Malaysia; Iris Gunther, Director Brand Enforcement and Sustainability, International Trademark Association (INTA); and Seth Hays, Chief Representative Asia Pacific Office, International Trademark Association (INTA). The programme then continued with a workshop that was divided into three sessions. The Honourable Datuk Wong Kian Kheong High Court Judge conducted the first session as moderator for the “An Overview Over TMA 2019 – Changes to Malaysian TM Law and The International Perspective” session. He represented Assoc. Prof. Rohazar Wati Binti Zuallcobley from Faculty of Law, MARA University of Technology and Juan Rodriguez Guerra, Senior Legal Counsellor, Legal Divison of The Madrid Registry at The World Intellectual Property Organization (WIPO), Switzerland. While the second session, “Select Changes to The TMA in Comparison with Other Jurisdictions”, was presented by Maxim Hristov, Attorney at Law, PETOSEVIC Bulgaria; and Bob Kelson, Principal, BK Patent and Trademark Consultation, Australia, with The Honourable Dato’ Mohd Radzi bin Harun, High Court Judge as moderator. The Honourable Datuk Hanipah Binti Farikullah, Judge of Court of Appeal, conducted the third session as moderator for the title “Enforcement of IPR Against Online Violation”, which was presented by Andrej Stec, Advisor (Referendaire), General Court European Union in Luxembourg; and Cecilia Dou, Online IP Enforcement Manager, Apple Inc. China.

  • Interpretation of Statutes, 6 March 2020

    The “Interpretation of Statutes” Course was held on 6th March 2020 (Friday) at the Banquet Hall, Palace of Justice, Putrajaya. The course objective is to enhance Judges and Judicial Commissioners knowledge and skills in interpretation of statutes.

    This course was divided into 3 sessions; speakers presentaion session, group discussion of case studies and case study presentations. The first session of the course began with the presentation of a lecture on this course by The Honourable Puan Sri Dato' Zaleha binti Yusof, Federal Court Judge. The second session was a group discussion on assigned case studies conducted by The Honourable Dato' Umi Kalthum binti Abdul Majid, Judge of the Court of Appeal. Participants were divided into five groups. Each group was assigned with one case study for discussion and presented their findings in the third session. Discussions between participants and facilitators were held after the presentation to provide a comprehensive understanding.

    A total of 23 participants attended the course. They were 6 High Court Judges and 17 Judicial Commissioners. The Right Honourable Tan Sri Tengku Maimun binti Tuan Mat, Chief Justice of Federal Court, Malaysia was also present.

  • Islamic Banking Structures and Products: Issues and Challenges, 24-25 April 2014

    The Islamic Banking Structures and Products: Issues and Challenges workshop was jointly organised by the Judicial Appointments Commission and Bank Negara Malaysia. This workshop was officiated by YAA Tan Sri Dato’ Seri Zulkefli bin Ahmad Makinudin, Chief Judge of Malaya. The objective of the programme is to expose judges to the structures and products related to Islamic banking as well as to identify the main legal issues and challenges in Islamic banking and finance.

    There was also an introduction to the essentials of Shari’ah covering fiqh muamalat and maqasid shari’ah. The workshop also discussed the principles and application of sale-based, lease-based and equity-based contracts in Islamic banking in addition to also touching on the supporting mechanisms in the Islamic banking system.

    This workshop was conducted entirely by YBhg. Dato’ Dr. Asyraf Wajdi bin Dato’ Haji Dusuki, Chairman, Yayasan Dakwah Islamiah Malaysia (YADIM). A total of 32 participants comprising 19 High Court Judges and 13 Judicial Commissioners attended this workshop which was held over 2 days from 24-25 April 2014 at Lanai Kijang, Bank Negara Malaysia, Kuala Lumpur.

     

  • Islamic Finance Workshop Series For Judges : Managing Islamic Banking Cases, 28th-29th June 2013

    The Islamic Finance Workshop Series for Judges : Managing Islamic Banking Cases” is the first workshop co-organised by both the Judicial Appointments Commission (JAC) and Bank Negara Malaysia (BNM). It was held on 28-29 June 2013 at Lanai Kijang, Bank Negara Malaysia, Kuala Lumpur.

    This workshop was officiated by The Rt. Hon. Tun Arifin bin Zakaria, Chief Justice. Also in attendance were The Rt. Hon. Tan Sri Md. Raus bin Sharif, President of the Court of Appeal, The Rt. Hon. Tan Sri Dato’ Seri Zulkefli bin Ahmad Makinudin, Chief Judge of Malaya and YBhg. Tan Sri Zeti Akhtar Aziz, Governor of Bank Negara.

    The objective of this workshop was to expose judges to the current issues and major challenges faced by Islamic banking institutions in relation to the law. As such, the workshop was structured to discuss salient aspects in managing Islamic banking cases as follows:

    (i) Introducing key syariah principles applicable in Islamic finance transactions;
    (ii) Discussing sale-based contracts commonly used in Islamic financial transactions including implementation of ibra’ (rebate);
    (iii) Discussing equity-based and lease-based syariah contract including a discussion on wa'd(promise) ; and 
    (iv) Discussing the common sukuk structure, The legal framework and relevant issues.

Each lecturer was allotted an hour while the panels had between 45 minutes and 1½ hours.The closing ceremony was officiated by The Rt. Hon. Tan Sri Dato’ Seri Zulkefli bin Ahmad Makinudin, Chief Judge of Malaya.

    Launching of Journal of the Malaysian Judiciary at Palace of Justice, 22 July 2016

    The launching of the Journal of the Malaysian Judiciary was held on July 20th, 2016 (Wednesday), 12.30 pm at the Banquet Hall, Palace of Justice, Putrajaya. The programme began with a presentation of montage/video about the journey of the journal preparation, followed by welcoming speech by The Honourable Tan Sri Ahmad bin Haji Maarop, Chairman of the Publications Division of the Academy of Justice. The climax of the programme was reached by the event launching/opening by The Right Honourable Tun Arifin bin Zakaria, Chief Justice.

    The initiative of this journal publishing aims to promote the publication of legal texts produced by the members of Malaysian judiciary as well as to foster the learning and writing culture among them. The articles published in the inaugural issue of the journal were the writings by The Right Honourable Tun Arifin bin Zakaria (Chief Justice), The Right Honourable President of the Court of Appeal, The Right Honourable Chief Judge of Malaya and another two judges and a Justice Commissioner that all are written based on the "The Rule of Law" theme.

    A total of 149 audiences attended the launching event consisting of superior courts judges, The Attorney General, former judges, top management of Chief Registrar's Office of Federal Court, Judicial and Legal Officers, and representative from the Bar Council.
