  • Law Reform and the Judiciary 1 November 2019

    The “Law Reform and the Judiciary” Seminar was held on 1st November 2019 (Friday) at the Conference Hall, Palace of Justice, Putrajaya. The course objective was to familiarize judges and law officers on law reform and the role of the judiciary in law reform. The lecture was delivered by The Right Honourable Lord Justice Nicholas Green, Judge of the Court of Appeal of England and Wales who is also the Chair of the United Kingdom Law Commission; and The Right Honourable Lord Justice Malcolm John David Wallis, Judge of the Supreme Court of Appeal of South Africa.

    A total of 88 participants comprising 2 Federal Court Judges, 16 Court of Appeal Judges, 25 High Court Judges, 5 Judicial Commissioners and 40 Judicial and Legal Officers attended the lecture. The Right Honourable Tan Sri Tengku Maimun binti Tuan Mat, Chief Justice of Federal Court, Malaysia was also present.

  • Meeting on The Administration of Justice and Training for Superior Court Judges

    A Meeting on The Administration of Justice and Training for Superior Court Judges were held from 20-22 November 2015 in Langkawi, Kedah. A total of 17 judges, comprises of Managing Judges and Committee Members of the Judicial Academy attended the meeting, including YAA Tun Arifin bin Zakaria, Chief Justice of Malaya, YAA Tan Sri Md. Raus bin Sharif, President of the Court of Appeal and YAA Tan Sri Dato’ Seri Zulkefli bin Ahmad Makinudin, Chief Judge of the High Court in Malaya.

    The Meeting’s primary objective is to analyse all the activities that has been carried out for the year 2015, to make suggestions and recommendations towards the improving of the administration of justice.

    Among the agendas discussed in the Meeting are the Role and the Assessment of Managing Judges; A Review of Training Programmes Carried Out Under The Purview of The Judicial Academy and Recommendations for Future Training Programmes; and The Establishment of the Publication Division, Judicial Academy.

  • Principles of Contractual Interpretation 16 - 17 February 2019

    “Principles of Contractual Interpretation” Course was held on 16-17 February 2019 (Friday-Saturday) at the Conference Hall, Palace of Justice, Putrajaya. The objective of this course is to develop knowledge and skill on interpretation of contracts among participants.

    A total of 23 participants attended this course consisting of 14 High Court Judges and 9 Judicial Commissioners. The facilitators of this course are The Right Honourable Datuk Seri Panglima David Wong Dak Wah, Chief Judge of Sabah and Sarawak; The Honourable Tan Sri Dato’ Sri Azahar bin Mohamed, Federal Court Judge and Chairman of the Training Committee, Judicial Academy; The Honourable Dato’ Mary Lim Thiam Suan, Judge of the Court of Appeal; and The Honourable Datuk Hasnah binti Dato’ Mohammed Hashim; Judge of the Court of Appeal. This course was also attended by The Right Honourable Tan Sri Dato’ Seri Ahmad bin Haji Maarop, President of the Court of Appeal; and The Right Honourable Tan Sri Zaharah binti Ibrahim, Chief Judge of the High Court in Malaya.

    This course was divided into 3 sessions. The first session on the first day began with the presentation on assigned topics and discussion related to this course that were presented by participants from 5 High Court Judges and 3 Judicial Commissioners. The second session on the first and second day was a group discussion on assigned case studies. Participants were divided into five groups of four or five members in each group. Each group was assigned with one case study for discussion and presented their findings in the third session in the afternoon of the second day. Discussions between participants and facilitators were also held after the presentation to provide a comprehensive understanding to the participants. Overall, the participants have given excellent feedback about this course.

  • Principles of Contractual Interpretation 20th - 21st September 2019

    The “Principles of Contractual Interpretation” Course was held on 20th – 21st September 2019 (Friday-Saturday) at the Banquet Hall, Palace of Justice, Putrajaya. The course objective was to develop participants’ knowledge and skills on interpretation of contracts.

    This course was divided into three sessions. The first session began with presentations on assigned topics and discussion on contract interpretation that were presented by participants from five High Court Judges and two Judicial Commissioners. The second session had continued with group discussion on assigned case studies. Participants were divided into five groups of four or five members in each group. Each group received assignment of three case studies for discussion and presented their findings in the third session on the second day. The participants and facilitators had also discussed about the presentation to provide a comprehensive understanding. This course received good feedbacks from participants as well as facilitators.

    A total of 22 participants consisting of 16 High Court Judges and six Judicial Commissioners had attended the course. The facilitators of this course were The Right Honourable Tan Sri Datuk Seri Panglima David Wong Dak Wah, Chief Judge of Sabah and Sarawak; The Honourable Dato’ Mary Lim Thiam Suan, Judge of the Court of Appeal; and The Honourable Datuk Hasnah binti Dato’ Mohammed Hashim, Judge of the Court of Appeal.   • Quantification of Damages, 7th September 2019

    The “Quantification of Damages” Seminar was held on 7th September 2019 (Saturday) at the Conference Hall, Palace of Justice, Putrajaya. The course aimed at providing an overview on quantification of damages to participants. This programme entailed 5 talk topics. A total of three talks were delivered in the morning session entitled “Financing Reporting in Malaysia”, “Valuation: Art, Science or Magic?” and “Valuation of Shares and Businesses - How Reliable are the Various Valuation Methods?”. The seminar had held two talks in the evening session entitled “Valuation of Damages - Are Lawyers and Valuers Speaking the Same Language?” and “Minding the (Valuation) Gap”. These talks were delivered by Dato’ Mohammad Faiz Azmi, Executive Chairman - PwC Malaysia; Mr. Jay Moorthy, Partner - Valuations Leader, PwC Malaysia; Mr. Michael Peer, Partner - Dispute Advisory Leader, PwC South East Asia; and Mr. Justin Lim Chee Teong, CA, Director - Valuations, PwC Malaysia. There was a Q&A session at the end of each talk.

    A total of 106 participants had attended this seminar. They were six Federal Court Judges, 20 Court of Appeal Judges, 41 High Court Judges, 16 Judicial Commissioners and 23 Judicial and Legal Officers. The Right Honourable Dato’ Seri Utama Tengku Maimun binti Tuan Mat, Chief Justice of Federal Court, Malaysia; The Right Honourable Tan Sri Dato’ Sri Ahmad bin Haji Maarop, President of the Court of Appeal, Malaysia; and The Right Honourable Tan Sri Dato’ Sri Azahar bin Mohamed, Chief Judge of the High Court in Malaya cum the Chairman of the Training Committee, Judicial Academy were also present.

  • Regulating the Capital Market: Changing Dynamics and Challenges, 5-6 June 2014

    A seminar, jointly organised by the Securities Commission and the Judicial Appointments Commission, entitled “Regulating the Capital Market: Changing Dynamics and Challenges” was held from 5-6 June 2014 in Kuala Lumpur.

    The seminar was officiated by the Rt. Hon. Tun Arifin bin Zakaria, Chief Justice. Also in attendance were the Rt. Hon. Tan Sri Md. Raus bin Sharif, President of the Court of Appeal and YBhg. Datuk Ranjit Ajit Singh, Chairman, Securities Commission Malaysia.

    The aim of the seminar was to provide an overview in relation to:

    • The development of Malaysian capital market and its role in funding the real economy;

    • The role of the Securities Commission in developing and maintaining the integrity of the capital market;

    • Board governance and effectiveness; and

    • Investor empowerment.

    A total of 55 participants attended this seminar comprising 2 members from the Commission, 8 Federal Court judges, 19 Court of Appeal judges, 20 High Court judges and 6 Judicial Commissioners.
