  • “Criminal Law: Evidence and Procedure” 22-23 September 2017

    The Course of “Criminal Law: Evidence and Procedure” was held from 22-23 September 2017 (Friday-Saturday) at the Banquet Hall, Palace of Justice, Putrajaya. This course objective is to provide Judges/Judicial Commissioners with a comprehensive understanding of certain aspects of the law of criminal evidence and procedure.

    The course was attended by 23 participants consisting of 14 Judges and 9 Judicial Commissioners. The facilitators for this course were The Right Honorable Tan Sri Datuk Wira Ahmad bin Haji Maarop, Chief Judge of the High Court in Malaya, The Honorable Tan Sri Azahar bin Mohamed, Federal Court Judge who is also the Chairman of the Judicial Academy and The Honorable Dato’ Tengku Maimun binti Tuan Mat, Court of Appeal Judge.

    The course was divided into 2 sessions. The first session was an individual presentation session by 10 Judges and 4 Judicial Commissioners on various topics pertaining to “Criminal Law: Evidence and Procedure” with and each presenter was given 10 minutes to present, followed by 15 minutes discussion. In the second session, the participants were divided into 4 groups consisting of 5 to 6 people each group. Each group was assigned with two case studies and was subsequently asked to present the findings at the end of the session and each group was allocated 20 minutes for presentation. An interactive discussion and question-and-answer session led by the facilitators were conducted at the end of each session to enable participants to share their knowledge views and understanding on the topics and case studies that have been presented.

  • A Lecture Entitled “Eastminster - Constitution - Making In Malaysia And Commonwealth Asia Following Independence”

    A lecture entitled “Eastminster - Constitution - Making in Malaysia and Commonwealth Asia Following Independence” was held on 11 November 2017 (Saturday) at the Conference Hall, Palace of Justice, Putrajaya. The lecture was delivered by Dr. Harshan Kumarasingham, a historian, politic and constitutional expert. He is a Lecturer in British politics at the University of Edinburgh and Senior Research Fellow at the Institute of Commonwealth Studies, University of London. This talk broadly examined the history of constitution making in Malaysia following independence. The speaker also explored the comparison between the concept of Eastminster and Westminister in the constitution making and its consequences to all of Asia.

    A total of 70 participants comprising 8 Federal Court Judges, 20 Court of Appeal Judges, 27 High Court Judges, 12 Judicial Commissioners and 2 Judicial Officers attended the lecture. The Right Honourable Tan Sri Datuk Wira Ahmad bin Haji Maarop, Chief Judge of the High Court in Malaya and The Honourable Tan Sri Azahar bin Mohamed, Federal Court Judge as the Chairman of the Training Committee of the Judicial Academy were also present. The implementation of this program received positive feedback from all participants.

  • Appointed New JAC Member 2017, 17 April 2017

    The following persons appointed as commissioners of the Judicial Appointments Commission in accordance with subsection 5(1)(f) of the Judicial Appointments Commission Act 2009 (Act 695) effective 17 April 2017. The four appointed are :-

    1.YABhg. Tun Arifin bin Zakaria,former Chief Justice,
    2.YBhg. Dato' Anantham a/l Kasinather, retired Judge of the Court of Appeal,
    3.YBhg. Datu Haji Abdul Razak Tready, retired Sarawak State Attorney General and,
    4.YBhg. Prof. Dr. Choong Yeow Choy, Lecture Faculty of Law, University of Malaya.

    These recent appointments are to replace outgoing commissioners namely,

    1.YBhg. Tan Sri Haidar bin Mohamed Noor,former Chief Judge of Malaya , 
    2.YBhg. Datuk Seri Panglima Sulong Matjeraie, retired Federal Court Judge, 
    3.YBhg. Dato’ Selventhiranathan a/l Thiagarajah, retired judges of the Court of Appeal and,
    4.YBhg. Dato’ Tee Ah Sing @ Tee Boon Hooi, retired judges of the Court of Appeal. , all whose tenure end on the 9 February 2017.

    The Judicial Appointments Commision records its utmost appreciation for the contribution and services of YBhg. Tan Sri Haidar bin Mohamed Noor, YBhg. Tan Sri Datuk Seri Panglima Sulong Matjeraie, YBhg. Dato’ Selventhiranathan a/l Thiagarajah and YBhg.   • Case Management in Civil Cases, 12 - 13 May 2017

    The course ‘Case Management in Civil Cases' was held from 12-13 May 2017 at Istana Kehakiman, Putrajaya. The aim of this course was to develop and improve case management skills of the participants.

    Facilitators who conducted this course were the Rt. Hon. Tan Sri Dato' Seri Zulkefli bin Ahmad Makinudin, President of the Court of Appeal, the Hon. Tan Sri Azahar bin Mohamed, Federal Court Judge, the Hon. Datuk Vernon Ong Lam Kiat and the Hon. Datuk Hasnah binti Dato' Mohammed Hashim, Court of Appeal Judges. The Rt. Hon. Tan Sri Md Raus bin Sharif, Chief Justice and the Rt. Hon. Tan Sri Datuk Wira Ahmad bin Haji Maarop, Chief Judge of the High Court in Malaya were also present.

    The course was attended by 20 participants comprising 3 High Court Judges and 17 Judicial Commissioners.

    The course was divided into two sessions. The first session was the group presentation based on topics as determined by the facilitators. Each group consists of 5 members and they were given 45 minutes to present and discuss the assigned topic. The second session was a discussion on case study in which each group was given two cases to be discussed and the results were presented at the end of the session.

  • Case Management in Civil Cases, 12-13 Mei 2017

    Kursus ‘Case Management in Civil Cases’ telah diadakan pada 12-13 Mei 2017 di Istana Kehakiman, Putrajaya. Kursus ini bertujuan untuk meningkatkan kemahiran pengurusan kes di kalangan peserta kursus.

    Fasilitator-fasilitator kursus adalah terdiri daripada YAA Tan Sri Dato’ Seri Zulkefli bin Ahmad Makinudin, Presiden Mahkamah Rayuan, YA Tan Sri Azahar bin Mohamed, Hakim Mahkamah Persekutuan, YA Datuk Vernon Ong Lam Kiat dan YA Datuk Hasnah binti Dato’ Mohammed Hashim, Hakim-Hakim Mahkamah Rayuan. Kursus ini turut dihadiri oleh YAA Tan Sri Md Raus bin Sharif, Ketua Hakim Negara dan YAA Tan Sri Datuk Wira Ahmad bin Haji Maarop, Hakim Besar Malaya.

    Kursus ini telah dihadiri oleh seramai 20 orang peserta yang terdiri daripada 3 orang Hakim Mahkamah Tinggi dan 17 orang Pesuruhjaya Kehakiman.

    Kursus ini telah dibahagikan kepada 2 sesi. Sesi pertama merupakan sesi pembentangan hasil kerja kumpulan mengenai tajuk-tajuk yang telah ditentukan oleh fasilitator. Setiap kumpulan mengandungi 5 orang ahli dan 45 minit diperuntukkan bagi setiap kumpulan untuk pembentangan dan perbincangan.  Sesi kedua pula adalah kajian kes di mana setiap kumpulan diberikan dua kes untuk dibincangkan dan pembentangan diadakan di akhir sesi.

  • Companies Act 2016: Transforming the Corporate Landscape, 22 Julai 2017

    Kursus “Companies Act 2016: Transforming the Corporate Landscape” telah diadakan pada 22 Julai 2017 (Sabtu) di Dewan Persidangan, Istana Kehakiman, Putrajaya. Kursus ini diadakan bertujuan untuk memberi gambaran menyeluruh kepada para hakim mengenai pembaharuan undang-undang utama dalam mengawal undang-undang korporat di Malaysia.

    Seramai 100 orang peserta yang terdiri daripada 11 orang Hakim Mahkamah Persekutuan, 23 orang Hakim Mahkamah Rayuan, 44 orang Hakim Mahkamah Tinggi dan 16 orang Pesuruhjaya Kehakiman telah mengikuti kursus ini. Kursus ini turut dihadiri oleh YAA Tan Sri Dato’ Seri Zulkefli bin Ahmad Makinudin, Presiden Mahkamah Rayuan, YAA Tan Sri Datuk Wira Ahmad bin Haji Maarop, Hakim Besar Malaya dan YA Tan Sri Azahar bin Mohamed, Hakim Mahkamah Persekutuan selaku Pengerusi Akademi Kehakiman.

    Ceramah di Sesi Pertama kursus ini telah disampaikan oleh Puan Nor Azimah binti Abdul Aziz, Ketua Pegawai Eksekutif (Pengawalan dan Penguatkuasaan), Suruhanjaya Syarikat Malaysia yang bertajuk “An Overview of the New Companies Act 2016 [Act 777]”. Pada Sesi Kedua, beliau dan Encik Lee Shih dari SKRINE telah menyampaikan ceramah yang bertajuk “Strengthening the Corporate Governance: Impact on Directors and Shareholders”. Pada Sesi Ketiga seminar ini, Encik Lee Shih telah menyampaikan ceramah bertajuk “Reforming the Insolvency Law”.

  • Companies Act 2016: Transforming The Corporate Landscape, 22 July 2017

    The "Companies Act 2016: Changing Corporate Landscape" was held on 22 July 2017 (Saturday) at the Conference Hall, Palace of Justice, Putrajaya. This course objective is to provide an overview for judges on the reform of the principal legislation which governs corporate law in Malaysia.

    A total of 100 participants consisting 11 Federal Court Judges, 26 Court of Appeal Judges, 45 High Court Judges and 18 Judicial Commissioners were attended the course. The course was also attended by The Right Honourable Tan Sri Dato 'Seri Zulkefli bin Ahmad Makinudin, President of the Court of Appeal, The Right Honourable Tan Sri Datuk Wira Ahmad bin Haji Maarop, Chief Judge of the High Court in Malaya and The Honourable Tan Sri Azahar bin Mohamed, Federal Court Judge cum Chairman of the Judicial Academy.

    The First Session of the course was presented by Ms. Nor Azimah binti Abdul Aziz, Chief Executive Officer (Regulatory & Enforcement), Companies Commission of Malaysia on the title "An Overview of the New Companies Act 2016 [Act 777]". Later in the Second Session, she has partnered with Mr. Lee Shih from SKRINE to deliver a speech titled "Strengthening the Corporate Governance: Impact on Directors and Shareholders". The Third Session of the course was presented by Mr. Lee Shih on the title "Reforming the Insolvency Law.

  • Damages Part II - Tort, 6-7 Oktober 2017

    Kursus “Damages Part II - Tort” telah diadakan pada 6-7 Oktober 2017 (Jumaat-Sabtu) di Banquet Hall, Istana Kehakiman, Putrajaya. Kursus ini adalah kursus “Damages” kedua yang telah diadakan pada tahun ini selepas kursus bahagian pertama diadakan pada 7-8 April 2017. Objektif kursus ini adalah untuk menyediakan hakim-hakim mahkamah atasan dengan pengetahuan dan kemahiran dalam menilai ganti rugi kes-kes berkaitan tort dan alasan penghakiman.

    Kursus ini telah disertai oleh seramai 18 orang peserta yang terdiri daripada 10 orang Hakim dan 8 orang Pesuruhjaya Kehakiman. Fasilitator-fasilitator kursus ini terdiri daripada YAA Tan Sri Datuk Seri Panglima Richard Malanjum, Hakim Besar Sabah dan Sarawak; YA Dato’ Abang Iskandar bin Abang Hashim, Hakim Mahkamah Rayuan; YA Datuk Nallini Pathmanathan, Hakim Mahkamah Rayuan; dan YA Datuk Vernon Ong Lam Kiat, Hakim Mahkamah Rayuan. Sesi soal jawab dan diskusi interaktif kelolaan para fasilitator kursus telah dilaksanakan di akhir setiap sesi bagi membolehkan para peserta mendapatkan pemahaman mendalam mengenai topik dan kajian kes yang telah dibentangkan.

  • Damages Part II - Tort, 6th - 7th October 2017

    The Course of “Damages Part II - Tort” was held from 6-7 October 2017 (Friday-Saturday) at the Banquet Hall, Palace of Justice, Putrajaya. This course is the second "Damages" course that was held this year after the first part of the course was held from 7-8 April 2017. This course objective is to develop knowledge and skill of Judges/Judicial Commissioners in assessing damages in tort related cases and judgement writing.

    This course was attended by 18 participants consisting of 10 Judges and 8 Judicial Commissioners. The facilitators for this course were The Right Honourable Tan Sri Datuk Seri Panglima Richard Malanjum, Chief Judge of the High Court in Sabah and Sarawak; The Honourable Dato’ Abang Iskandar bin Abang Hashim, Judge of the Court of Appeal; The Honourable YA Datuk Nallini Pathmanathan, Judge of the Court of Appeal; and The Honourable Datuk Vernon Ong Lam Kiat, Judge of the Court of Appeal. The Right Honourable Tun Raus Sharif, Chief Justice; The Right Honourable Tan Sri Dato’ Seri Zulkefli bin Ahmad Makinudin, President the Court of Appeal; and The Honourable Tan Sri Azahar bin Mohamed, Federal Court Judge who is also the Chairman of the Judicial Academy were also present.

  • Damages, 7 - 8 April 2017

    Kursus ‘Damages’ ini merupakan kali pertama diadakan. Fasilitator-fasilitator kursus kali ini terdiri daripada YAA Tan Sri Datuk Seri Panglima Richard Malanjum, Hakim Besar Sabah dan Sarawak, YA Tan Sri Idrus bin Harun, Hakim Mahkamah Rayuan, YA Datuk Nallini Pathmanathan, Hakim Mahkamah Rayuan dan YA Datuk Vernon Ong Lam Kiat, Hakim Mahkamah Rayuan. Kursus ini turut dihadiri oleh YAA Tan Sri Md Raus bin Sharif, Ketua Hakim Negara, YAA Tan Sri Dato’ Seri Zulkefli bin Ahmad Makinudin, Presiden Mahkamah Rayuan dan YA Tan Sri Azahar bin Mohamed, Hakim Mahkamah Persekutuan selaku Pengerusi Jawatankuasa Latihan, Akademi Kehakiman.

    Seramai 19 orang peserta telah menghadiri kursus ini yang terdiri daripada 11 orang Hakim Mahkamah Tinggi dan 8 orang Pesuruhjaya Kehakiman.

    Kursus ini telah dibahagikan kepada 2 sesi. Sesi pertama merupakan sesi pembentangan oleh 10 peserta yang mewakili kumpulan yang terdiri daripada 2 orang mengenai tajuk-tajuk perbincangan sebagaimana ditentukan oleh fasilitator yang berkaitan dengan kes-kes ‘damages’. Masa pembentangan adalah selama 10 minit dan disusuli dengan perbincangan oleh peserta selama 15 minit. Pada sesi kedua pula adalah bengkel mengenai ‘damages’ di mana setiap kumpulan diberikan satu permasalahan untuk dibincangkan dan bentangkan di akhir sesi.

    'Damages' course was premierly held in our department, consisting of 19 participants; 11 High Court judges and 8 Judicial Commissioners including The Right Honourable Tan Sri Datuk Seri Panglima Richard Malanjum, Chief Judge of the High Court in Sabah and Sarawak, The Honourable Tan Sri Idrus bin Harun, Judge of the Court of Appeal, The Honourable Datuk Nallini Pathmanathan, Judge of the Court of Appeal and The Honourable Datuk Vernon Ong Lam Kiat, Judge of the Court of Appeal. This course was also attended by The Right Honourable Tan Sri Md Raus bin Sharif, Chief Justice, The Right Honourable Tan Sri Dato’ Seri Zulkefli bin Ahmad Makinudin, President of The Court of Appeal and The Honourable Tan Sri Azahar bin Mohamed, Federal Court Judge as Chairman of the Training Committee, Judicial Academy.

    A total of 19 participants attended the course which consists of 11 High Court judges and 8 Judicial Commissioners.

    This course was divided into two sessions. The first session is a presentation by 10 participants representing groups of 2 people on discussion topics as defined by the facilitators regarding to 'damages' cases. Time given for presentation is 10 minute and followed by a discussion by participants for 15 minutes. At the second session is the workshop on 'damages' which each group is given the problems to be discussed and presented at the end of the session.

     

  • Defamation Law, 18 - 19 November 2016

    Kursus “Defamation Law’” telah diadakan pada 18 dan 19 November 2016 di Putrajaya. Kursus ini merupakan satu lagi kursus baharu anjuran Akademi Kehakiman dalam tahun 2016. Fasilitator-fasilitator kursus ini ialah YAA Tan Sri Dato’ Seri Zulkefli bin Ahmad Makinudin, Hakim Besar Malaya, YA Tan Sri Azahar bin Mohamed, Hakim Mahkamah Persekutuan dan YA Datuk Vernon Ong Lam Kiat, Hakim Mahkamah Rayuan. Seramai 10 orang Hakim Mahkamah Tinggi dan 10 orang Pesuruhjaya Kehakiman telah mengikuti kursus ini.

    Kursus ini telah dibahagikan kepada 2 sesi. Di sesi pertama, 16 orang Hakim Mahkamah Tinggi dan Pesuruhjaya Kehakiman telah membentang tajuk-tajuk perbincangan sebagaimana ditentukan oleh fasilitator. Pembentangan setiap peserta adalah selama 10 minit dan disusuli dengan perbincangan selama 15 minit. Di sesi kedua pula, peserta telah dibahagikan kepada 4 kumpulan bengkel. Setiap kumpulan telah diberikan 2 tugasan. Peserta dikehendaki menyediakan hasil tugasan tersebut untuk dibentang dan dibincangkan.

  • Defamation Law, 18-19 August 2017

    The course “Defamation Law” was held from 18-19 August 2017 (Friday and Saturday) at the Banquet Hall, Palace of Justice, Putrajaya. The objective of this course was to develop and increase the knowledge and skills of Judges/Judicial Commissioners in managing and determining defamation cases.

    A total of 20 participants comprising 10 Judges and 10 Judicial Commissioners attended the course. The facilitators who conducted this course were The Right Honourable Tan Sri Dato'Seri Zulkefli bin Ahmad Makinudin, President of the Court of Appeal, The Right Honourable Tan Sri Datuk Wira Ahmad bin Haji Maarop, Chief Judge of the High Court in Malaya, The Honourable Tan Sri Azahar bin Mohamed, Federal Court Judge and The Honourable Datuk Vernon Ong Lam Kiat, Court of Appeal Judge. The Right Honourable Tan Sri Dato’ Seri Md Raus bin Sharif was also present.

    This course was divided into 2 sessions. The first session was an individual presentation by 9 Judges and 9 Judicial Commissioners on various topics pertaining to “Defamation Law” as determined by the facilitators. The second session was a discussion of the case study. The participants were divided into 4 groups. Each group was assigned to discuss two case studies and was subsequently asked to present their findings. An interactive discussion and question-and-answer session led by the facilitators were conducted at the end of each session to enable the participants to enhance their knowledge and understanding on the topics and case studies discussed.

  • Defamation Law, 18-19 Ogos 2017

    Kursus “Defamation Law” telah diadakan pada 18-19 Ogos 2017 (Jumaat dan Sabtu) di Dewan Banquet , Istana Kehakiman, Putrajaya. Objektif kursus ini adalah untuk meningkatkan pengetahuan serta kemahiran para Hakim/Pesuruhjaya Kehakiman dalam mengendali dan memutuskan kes-kes saman fitnah.

    Seramai 20 orang peserta yang terdiri daripada 10 orang Hakim dan 10 orang Pesuruhjaya Kehakiman telah menghadiri kursus ini. Fasilitator-fasilitator kursus terdiri daripada YAA Tan Sri Dato’ Seri Zulkefli bin Ahmad Makinudin, Presiden Mahkamah Rayuan, YAA Tan Sri Datuk Wira Ahmad bin Haji Maarop, Hakim Besar Malaya, YA Tan Sri Azahar bin Mohamed, Hakim Mahkamah Persekutuan dan YA Datuk Vernon Ong Lam Kiat, Hakim Mahkamah Rayuan. YAA Tan Sri Md Raus bin Sharif, Ketua Hakim Negara turut hadir ke kursus ini.

    Kursus ini telah dibahagikan kepada 2 sesi. Sesi pertama merupakan pembentangan individu oleh 9 orang Hakim dan 9 orang Pesuruhjaya Kehakiman mengenai pelbagai topik berkaitan “Defamation Law” yang telah ditentukan oleh fasilitator Manakala pada sesi kedua, peserta kursus telah dibahagikan kepada 4 kumpulan. Setiap kumpulan ditugaskan untuk membincangkan dua kajian kes dan seterusnya diminta membentangkan hasil kajian kes tersebut. Perbincangan secara interaktif dan sesi soal jawab yang dikendalikan oleh fasilitator kursus telah dilaksanakan di akhir setiap sesi bagi membolehkan para peserta meningkatkan kefahaman mereka mengenai topik dan kajian kes yang dibincangkan.

  • How to Deal with Cases Under Section 302 of the Penal Code, 31 Mac – 1 April 2017

    Kursus ‘How to Deal with Cases Under Section 302 of the Penal Code’ telah diadakan di Istana Kehakiman, Putrajaya pada 31 Mac – 1 April 2017 (Jumaat dan Sabtu). 

    Seramai 16 peserta telah menghadiri kursus ini yang terdiri daripada 7 orang Hakim Mahkamah Tinggi dan 9 orang Pesuruhjaya Kehakiman. Fasilitator yang mengendalikan kursus ini ialah YAA Tan Sri Ahmad bin Haji Maarop, Hakim Besar Malaya, YA Tan Sri Azahar bin Mohamed, Hakim Mahkamah Persekutuan dan YA Dato’ Setia Mohd Zawawi bin Salleh, Hakim Mahkamah Rayuan. 

    Kursus ini telah dibahagikan kepada 2 sesi. Di sesi pertama, 13 peserta telah membentang tajuk-tajuk perbincangan sebagaimana ditentukan oleh fasilitator yang berkaitan dengan kes-kes di bawah Kanun Keseksaan (Penal Code) [Akta 574] dan beberapa peruntukan undang-undang lain yang berkaitan seperti Akta Keterangan 1950 (Evidence Act 1950) [Akta 56]. Masa pembentangan adalah selama 10 minit dan disusuli dengan perbincangan oleh peserta selama 15 minit. 

    Sesi kedua pula merupakan perbincangan terhadap alasan penghakiman perbicaraan jenayah yang berkaitan dengan peruntukan seksyen 302 Kanun Keseksaan yang disediakan oleh fasilitator. Peserta-peserta telah dipilih untuk membuat pengenalan terhadap kes-kes yang dibincangkan selama 5 minit dan disusuli dengan perbincangan selama 15 minit.
