  • Appellate Intervention and Revision, 6 & 7 Julai 2013

    Kursus “Appellate Intervention and Revision” merupakan kursus kelima diadakan di bawah Akademi Kehakiman selepas kursus-kursus “Company Law” pada 23 & 24 Februari 2013, “The Construction Industry Payment and Adjudication Act 2012: The Role of the Court” pada 15 & 16 Mac 2013, “How To Deal With Cases Under 39B of The Dangerous Drugs Act 1952” pada 20 & 21 April 2013 dan “Islamic Finance Workshop Series for Judges: Managing Islamic Banking Cases” pada 28 & 29 Jun 2013.

    Seramai 14 peserta telah menghadiri kursus ini. Ia terdiri daripada 11 Hakim Mahkamah Tinggi, 3 Pesuruhjaya Kehakiman. Fasilitator yang mengendalikan kursus ini adalah YAA Tan Sri Md. Raus bin Sharif, Presiden Mahkamah Rayuan dan YA Datuk Zaharah binti Ibrahim, Hakim Mahkamah Rayuan.

    Kursus ini telah dibahagikan kepada 6 sesi. Di setiap sesi, setiap kumpulan yang terdiri daripada 4 peserta akan membentangkan tajuk-tajuk perbincangan sebagaimana ditentukan oleh fasilitator, Masa pembentangan dan perbincangan setiap sesi adalah selama 1- 2 jam.   • Appellate Intervention and Revision,6th-7th July 2013

    The course “Appellate Intervention and Revision” is the fifth course organised by the Judicial Academy this year after other courses such as “Company Law” on 23 & 24 February 2013, “The Construction Industry Payment and Adjudication Act 2012: The Role of the Court” on 15 & 16 March 2013, “How To Deal With Cases Under 39B of The Dangerous Drugs Act 1952” on 20 & 21 April 2013 and “Islamic Finance Workshop Series for Judges: Managing Islamic Banking Cases” on 28 & 29 June 2013.

    A total of 14 participants attended this course. They were made up of 11 High Court judges and 3 Judicial Commissioners. The facilitators were The Rt. Hon. Tan Sri Md. Raus bin Sharif, President of the Court of Appeal and The Hon. Datuk Zaharah binti Ibrahim, Judge of the Court of Appeal

    This course was divided into 6 sessions. In each session, groups of 4 persons presented their respective topics of dicsussion as pre-determined by the facilitators. The time given for each presentation and ensuing discussion was between 1-2 hours. The topics for each module and group are as follows:

  • Bengkel Penyemakan Manual Prosedur Kerja Pejabat Setiausaha Suruhanjaya Pelantikan Kehakiman, 24 - 26 April 2013

    Bengkel Penyemakan Manual Prosedur Kerja Pejabat Setiausaha Suruhanjaya Pelantikan Kehakiman telah diadakan di The Zon Regency Hotel, Johor Bahru pada 24 - 26 April 2013.

  • Company Law, 23-24 Februari 2013

    Kursus “Company Law” merupakan kursus yang pertama diadakan di bawah Akademi Kehakiman bagi tahun 2013. Ia telah diadakan pada 23-24 Februari 2013 di Putrajaya. Seramai 15 orang peserta yang terdiri daripada 7 Hakim Mahkamah Tinggi dan 8 Pesuruhjaya Kehakiman telah menghadiri kursus ini.

    Kursus ini telah dikendalikan oleh 3 orang hakim fasilitator yang berpengalaman luas dalam bidang Company Law iaitu YA Dato’ Hishamudin b. Md. Yunus, Hakim Mahkamah Rayuan; YA Dato’ Mohamad Ariff b. Md. Yusof, Hakim Mahkamah Rayuan dan YA Puan Nallini Pathmanathan, Hakim Mahkamah Tinggi Kuala Lumpur. 

    Kursus ini telah dibahagikan kepada 2 bahagian. Bahagian pertama fasilitator-fasilitator telah membentangkan kertas pengenalan kepada Company Law yang terdapat di United Kingdom dan di Malaysia. Ia kemudian diikuti dengan Bahagian Kedua iaitu pembentangan kertas kerja oleh peserta-peserta mengikut tajuk-tajuk yang telah diberikan terlebih awal oleh fasilitator sebelum mereka datang menghadiri kursus. Setiap pembentangan disusuli dengan perbincangan. Sebanyak 15 tajuk kertas perbincangan telah dibentangkan dalam kursus ini. 

     

  • Company Law, 23-24 Februari 2013

    Kursus “Company Law” merupakan kursus yang pertama diadakan di bawah Akademi Kehakiman bagi tahun 2013. Ia telah diadakan pada 23-24 Februari 2013 di Putrajaya. Seramai 15 orang peserta yang terdiri daripada 7 Hakim Mahkamah Tinggi dan 8 Pesuruhjaya Kehakiman telah menghadiri kursus ini.

  • Dialogue Session Between The Honourable Society of The Middle Temple And Malaysian Judiciary

    A dialogue between the Honourable Society of the Middle Temple and Malaysian Judiciary was held on the 21 September 2013 (Saturday) at the Palace of Justice, Putrajaya. This programme was jointly organized by the Office of the Chief Registrar of the Federal Court and the Office of the Secretary, Judicial Appointments Commission.

    The purpose of the dialogue was to facilitate the exchange of ideas between both the Malaysian Judiciary and the Honourable Society of the Middle Temple and to discuss the issues and problems faced by the judiciaries of both countries.

    The Honourable Society of the Middle Temple was represented by 32 members led by Master Treasurer Mr. Christopher Symons QC. Also in the delegation were the Lord Chief Justice of England and Wales - Lord Sir Igor Judge, Lord Justice of the Court of Appeal – Mr. Christopher Clarke and Judges of the High Court of England and Wales. There were 66 judges/judicial commissioners for the Malaysian Judiciary comprising the Chief Judge of Malaya, the Chief Judge of Sabah and Sarawak, Judges of the Federal Court, Court of Appeal, High Court and Judicial Commissioners from around the Klang Valley.

    The dialogue began with a welcome speech from the Rt. Hon. Tan Sri Dato’ Seri Zulkefli bin Ahmad Makinudin, Chief Judge of Malaya and was followed by a historical overview of the law and the Malaysian Judiciary by the Hon. Nallini Pathmanathan, High Court Judge, Kuala Lumpur. The Judiciary of England and Wales then went on to discuss the following matters:

    (i) The Relationship between Judiciary and Press by Lord Sir Igor Judge, Lord Chief Justice of England and Wales;

    (ii) Judicial Life - Trials and Tribulations by Mr. Christopher Clarke, Lord Justice of the Court of Appeal; and

    (iii) Challenges Facing the Judiciary Today by Sir Paul Jenkins KCB QC, Treasury Solicitor.

    The Malaysian Judiciary was represented by the Rt. Hon. Tan Sri Datuk Seri Panglima Richard Malanjum – Chief Judge of Sabah and Sarawak and the Hon. Dato’ Mohamad Ariff bin Md. Yusoff – Court of Appeal Judge, who shared their views on issues relating to the Malaysian Judiciary.The programme ended at 1.00pm after a question and answer session.

     

  • Dialogue Session Between The Honourable Society of The Middle Temple and Malaysian Judiciary, 21 September 2013

    Program “Dialogue Session between the Honourable Society of the Middle Temple and Malaysian Judiciary” telah diadakan pada 21 September 2013 (Sabtu) di Istana Kehakiman, Putrajaya. Ia merupakan program anjuran bersama Pejabat Ketua Pendaftar Mahkamah Persekutuan dan Pejabat Setiausaha, Suruhanjaya Pelantikan Kehakiman.

    Objektif penganjuran program ini adalah untuk membolehkan Badan Kehakiman negara ini dan pihak Middle Temple bertukar-tukar pandangan dan membincangkan beberapa permasalahan dan isu yang dihadapi oleh badan kehakiman kedua-dua buah negara.

    Delegasi Middle Temple terdiri daripada 32 orang ahli yang diketuai oleh Master Treasurer Mr. Christopher Symons QC. Antara ahli-ahli yang turut hadir adalah Lord Chief Justice of England and Wales - Lord Sir Igor Judge, Lord Justice of the Court of Appeal – Mr. Christopher Clarke dan Hakim-hakim Mahkamah Tinggi England dan Wales. Dari pihak Badan Kehakiman Malaysia pula, ia dihadiri oleh 66 hakim/pesuruhjaya kehakiman yang terdiri daripada Hakim Besar Malaya, Hakim Besar Sabah dan Sarawak, Hakim Mahkamah Persekutuan, Hakim Mahkamah Rayuan, Hakim Mahkamah Tinggi dan Pesuruhjaya Kehakiman di sekitar Lembah Klang.

    Program dialog ini dimulai dengan ucapan aluan daripada YAA Tan Sri Dato’ Seri Zulkefli bin Ahmad Makinudin, Hakim Besar Malaya dan disusuli dengan penerangan mengenai gambaran umum (overview) sejarah undang-undang dan Badan Kehakiman Malaysia oleh YA Puan Nallini Pathmanathan – Hakim Mahkamah Tinggi Kuala Lumpur. Selepas itu, program dialog ini mendengar pula pandangan dari Badan Kehakiman England dan Wales yang membincangkan perkara-perkara seperti berikut;

  • How To Deal With Cases Under 39B of The Dangerous Drugs Act 1952, 20th - 21st April 2013

    A course entitled How to Deal with Cases Under 39B of the Dangerous Drugs Act 1952 was held from 20 - 21 April 2013.

    A total of 14 participants attended this course. They were made up of 10 High Court Judges and 4 Judicial Coomissioners.     8 grounds of judgment of criminal cases related to section 39B chosen by the facilitators were also discussed. Participants were randomly selected at the beginning of the second session to create an introduction to the 5-minute discussion and followed by a 15-minute discussion.

Peserta-peserta telah dipilih secara rawak pada permulaan sesi kedua untuk membuat pengenalan terhadap kes-kes yang dibincangkan selama 5 minit dan disusuli dengan perbincangan selama 15 minit.

  • Islamic Finance Workshop Series For Judges : Managing Islamic Banking Cases, 28-29 Jun 2013

    Bengkel “Islamic Finance Workshop Series for Judges : Managing Islamic Banking Cases” adalah merupakan bengkel anjuran bersama yang julung-julung kali diadakan antara Suruhanjaya Pelantikan Kehakiman (SPK) dan Bank Negara Malaysia (BNM). Ia telah diadakan pada 28-29 Jun 2013 di Lanai Kijang, Bank Negara Malaysia, Kuala Lumpur.

    Bengkel ini telah dirasmikan oleh YAA Tun Arifin bin Zakaria, Ketua Hakim Negara. Ia turut dihadiri oleh YAA Tan Sri Md. Raus bin Sharif, Presiden Mahkamah Rayuan, YAA Tan Sri Dato’ Seri Zulkefli bin Ahmad Makinudin, Hakim Besar Malaya dan YBhg. Tan Sri Zeti Akhtar Aziz, Gabenor Bank Negara.

    Objektif bengkel ini adalah untuk mendedahkan hakim-hakim kepada isu-isu semasa dan mengenalpasti cabaran-cabaran utama terutamanya dalam aspek perundangan yang dihadapi dalam institusi perbankan Islam. Sehubungan itu, bengkel ini telah dirangka untuk membincangkan beberapa aspek penting dalam pengurusan perbankan Islam seperti:

    (i) memperkenalkan prinsip-prinsip utama syariah dalam sistem kewangan Islam; 
    (ii) Membincangkan sale-based contracts yang sering digunapakai dalam transaksi kewangan Islam dan pelaksanaan ibra’ (rebate); 
    (iii) Membincangkan prinsip-prinsip musharakah, mudarabah dan lease-based contracts termasuk perbincangan mengenai wa’d (promise); dan 
    (iv) Membincangkan struktur sukuk, kerangka perundangan dan isu-isu yang berkaitan.

    Seramai 10 orang penceramah yang pakar dalam bidang kewangan/perundangan Islam telah dijemput mengendalikan bengkel ini. Mereka adalah

    (i) Dr. Asyraf Wajdi Dato’ Dusuki, Yang Dipertua Yayasan Dakwah Islamiah Malaysia (YADIM) selaku moderator bengkel;
    (ii) Prof. Dr. Engku Rabiah Adawiah Engku Ali, Pensyarah Universiti Islam Antarabangsa;
    (iii) Assoc. Prof. Dr. Aznan Hassan, Pensyarah Universiti Islam Antarabangsa;(iv) Encik Mohamed Ridza Abdullah, Managing Partner, Messrs. Mohamed Ridza and Co.;
    (v) Encik Rafe Haneef, Ketua Pegawai Eksekutif, HSBC Amanah Malaysia;
    (vi) Encik Wan Mohd. Nazri Wan Osman, Pengarah Jabatan Perbankan Islam dan Takaful, Bank Negara Malaysia; 
    (vii) YABhg. Tun Abdul Hamid Mohamad, mantan Ketua Hakim Negara dan Chairman, Law Harmonisation Committee of Bank Negara Malaysia; 
    (viii) Dr. Mohd. Daud Bakar, Chairman of Syariah Advisory Council, Bank Negara Malaysia; 
    (ix) YA Dato’ Haji Mohd. Zawawi Salleh, Hakim Mahkamah Rayuan; dan 
    (x) YA Dato” Rohana Yusuf, Hakim Mahkamah Rayuan.

    Seramai 85 orang peserta yang terdiri daripada 56 Hakim Mahkamah Persekutuan, Hakim Mahkamah Rayuan, Hakim Mahkamah Tinggi dan Pesuruhjaya Kehakiman serta 29 Pegawai Kehakiman telah menghadiri bengkel ini. Bengkel ini telah dibahagikan kepada 5 sesi ceramah dan 2 perbincangan panel. Di setiap sesi ceramah diperuntukkan selama 1 jam, manakala panel perbincangan antara 45 minit hingga 1½ jam. Majlis penutupan rasmi bengkel ini telah disempurnakan oleh YAA Tan Sri Dato’ Seri Zulkefli bin Ahmad Makinudin, Hakim Besar Malaya.

  • Islamic Finance Workshop Series For Judges : Managing Islamic Banking Cases, 28th-29th June 2013

    The Islamic Finance Workshop Series for Judges : Managing Islamic Banking Cases” is the first workshop co-organised by both the Judicial Appointments Commission (JAC) and Bank Negara Malaysia (BNM). It was held on 28-29 June 2013 at Lanai Kijang, Bank Negara Malaysia, Kuala Lumpur.

    This workshop was officiated by The Rt. Hon. Tun Arifin bin Zakaria, Chief Justice. Also in attendance were The Rt. Hon. Tan Sri Md. Raus bin Sharif, President of the Court of Appeal, The Rt. Hon. Tan Sri Dato’ Seri Zulkefli bin Ahmad Makinudin, Chief Judge of Malaya and YBhg. Tan Sri Zeti Akhtar Aziz, Governor of Bank Negara.

    The objective of this workshop was to expose judges to the current issues and major challenges faced by Islamic banking institutions in relation to the law. As such, the workshop was structured to discuss salient aspects in managing Islamic banking cases as follows:

    (i) Introducing key syariah principles applicable in Islamic finance transactions;
    (ii) Discussing sale-based contracts commonly used in Islamic financial transactions including implementation of ibra’ (rebate);
    (iii) Discussing equity-based and lease-based syariah contract including a discussion on wa'd(promise) ; and 
    (iv) Discussing the common sukuk structure, The legal framework and relevant issues.

Each lecturer was allotted an hour while the panels had between 45 minutes and 1½ hours.The closing ceremony was officiated by The Rt. Hon. Tan Sri Dato’ Seri Zulkefli bin Ahmad Makinudin, Chief Judge of Malaya.

  • Visit and Meeting of The Judicial Appointments Commission at The Kuantan Court Complex, Pahang 3 April 2013

    The Judicial Appointments Commission held its monthly meeting No. 4/2013 at the Kuantan Court Complex, Pahang on 3 April 2013. The Commissioners visited several sections of the court such as the Registry of the Sessions / Magistrates Court and the Registry of the High Court. The aim of the visit was to look at the various ways undertaken by the courts in Kuantan to improve its delivery system.

    After the visit, the Commissioners were briefed by YA Dato' Sri Mariana binti Haji Yahya , High Court Judge Kuantan on the disposal of the backlog of cases and new cases in the various courts in Kuantan.The aim of the meeting was to look at the various ways undertaken by the courts in Kuantan to improve its delivery system.

  • Workshop " Constrution Law: Issues and Challenges"

    Construction Law : Issues and Challenges Workshop was held on 10th and 11th October 2013 and is the second collaboration between the Judicial Appointments Commission and the Kuala Lumpur Centre for Arbitration (KLRCA) in organising training for the judiciary. This is subsequent to seminar entitled “The Construction Industry Payment and Adjudicaton Act 2012 : Role of the Court “ held on 15th and 16th March 2013.

    The objective of this workshop was to enhance the participants’ understanding on the technical aspects relating to the construction industry and laws.

    This workshop was facilitated by Ir. Harbans Singh who is an arbitrator, adjudicator and professional mediator who specialises in construction law and alternative dispute resolution.

    A total of 19 participants comprising 3 Appeal Court judges, 10 High Court judges and 6 Judicial Commissioners attended this workshop. It was officiated by YAA Tun Arifin b. Zakaria, the Chief Justice.

    The workshop was divided into 8 modules that emphasised the main issues commonly encountered in the construction industry e.g project implementation, contract implementation, tender process and financial issues.

    The closing ceremony was graced by YAA Tan Sri Dato’ Seri Zulkefli b. Ahmad Makinudin, Hakim Besar Malaya.
