  • How to Deal with Cases Under 39B of the Dangerous Drugs Act 1952, 3-4 September 2015

    Kursus “How to Deal with Cases Under 39B of the Dangerous Drugs Act 1952” telah diadakan di Putrajaya pada 3-4 September 2015 (Khamis dan Jumaat).

    Seramai 15 peserta telah menghadiri kursus ini yang terdiri daripada 13 orang Hakim Mahkamah Tinggi dan 2 orang Pesuruhjaya Kehakiman. Fasilitator-fasilitator yang mengendalikan kursus ini adalah YAA Tan Sri Md Raus bin Sharif, Presiden Mahkamah Rayuan dan 2 oarang Hakim Mahkamah Persekutuan iaitu YA Tan Sri Ahmad bin Haji Maarop dan YA Dato’ Azahar bin Mohamed.     Kursus ini telah dibahagikan kepada 2 sesi. Di sesi pertama, 9 daripada 15 orang peserta telah dipilih untuk membentang tajuk-tajuk perbincangan yang berkaitan dengan kes-kes di bawah Akta Dadah Berbahaya 1952 serta beberapa peruntukan undang-undang lain yang berkaitan seperti Kanun Acara Jenayah. Masa pembentangan adalah selama 20 minit dan disusuli dengan perbincangan selama 10 minit. Tajuk-tajuk perbincangan adalah seperti berikut:

    Di sesi kedua, peserta-peserta telah dibahagikan kepada 3 kumpulan di mana setiap kumpulan mengandungi 5 orang ahli. Mereka diberi tugas untuk membincangkan alasan penghakiman kes sebenar. Di akhir sesi ini, seorang peserta dari setiap kumpulan telah membentangkan hasil penemuan kelemahan dan kekuatan alasan penghakiman tersebut dan selepas itu seorang peserta lain dari setiap kumpulan akan membentangkan alasan penghakiman yang disediakan oleh kumpulan tersebut berdasarkan kes itu.

     

  • How To Deal With Cases Under 39B of The Dangerous Drugs Act 1952, 3rd - 4th September 2015

    A course entitled “How to Deal with Cases Under 39B of the Dangerous Drugs Act 1952” was held in Putrajaya from 3-4 September 2015 (Thursday and Friday)

    A total of 15 participants attended this course comprising 13 High Court judges and 2 Judicial Commissioners. The facilitators were the Rt. Hon.     (i) Meaning of Prima Facie Case The course was divided into two sessions. In the first session, 9 out of 15 participants were selected to present discussion topics as determined by the facilitator. Topics were in relation to cases under the Dangerous Drugs Act 1952, particularly those involving the provision of section 39B, and a number of other related legal provisions such as the Criminal Procedure Code. The time given was 20 minutes for the presentation followed by a 10-minute discussion by the participants. The topics are as follows:

    In the second session, participants were divided into 3 groups of 5 members each. They were tasked with discussing the reasons for the judgment of a given case. At the end of this session, one participant from each group presented the findings of strengths and weaknesses of the grounds of judgment and this was followed by a presentation from a different participant on the reasons for the judgment prepared by the group based on the case.

  • Induction Programme for Judicial Commissioner, 15 - 22 December 2015

    An introductory course entitled “Induction Programme for Judicial Commissioner” has been held from 15 to 22 December 2015 in The Secretary’s Office, Judicial Appointments Commission, Palace of Justice, Putrajaya. The course’s primary objective is to prepare and enlighten the newly appointed Judicial Commissioners (JCs) on their duties, responsibilities and best practices.

    A total of 10 newly appointed JCs attended the course, and a total of 12 papers have been presented by a panel of speakers consisting of Senior Judges, namely the Federal Court Judges, Court of Appeal Judges and High Court Judges. The papers presented are Judge Craft, Case Management, Conducting Trial and Hearing, Capital Offences, How to Read Statute, Practical Approach to Judgment Writing, Family Law, Mediation, Land Acquisition, Civil Procedure: Salient Features of the Rules of Court 2012, High Court Special Powers and Salary, Allowances and Benefits for Judges.

  • Induction Programme for Judicial Commissioner, 15 - 22 Disember 2015

    Kursus Induction Programme for Judicial Commissioner telah diadakan pada 15 - 22 Disember 2015 di Pejabat Setiausaha, Suruhanjaya Perlantikan Kehakiman, Istana Kehakiman, Putrajaya. Ia bertujuan untuk mendedahkan Pesuruhjaya-Pesuruhjaya Kehakiman Yang baharu dilantik kepada bidang tugas Pesuruhjaya Kehakiman dan amalan-amalan terbaik (best practice) yang perlu diikuti semasa melaksanakan tugas dan tanggungjawab tersebut.

    Seramai 10 orang Pesuruhjaya Kehakiman yang baharu dilantik telah mengikuti kursus ini. Sebanyak 12 kertas telah dibentang oleh hakim-hakim kanan yang terdiri daripada Hakim Mahkamah Persekutuan, Hakim Mahkamah Rayuan dan Hakim Mahkamah Tinggi. Tajuk-tajuk kertas tersebut adalah Judge Craft, Case Management, Cunducction Trial and Hearing, Capital Offences, How to Read Statute, Practical Approach to Judgment Writing, Family Law, Mediation, Land Acquisition, Civil Procedure: Salient Features of the Rules of Court 2012, High Court Special Powers dan Salary, Allowances and Benifits for Judges.

  • Induction Programme for Judicial Commissioners, 13rd - 14th April 2015

    A course entitled “Induction Programme for Judicial Commissioners” was held from 13 - 14 April 2015 at the Palace of Justice, Putrajaya.

    A total of 5 newly appointed Judicial Commissioners attended this course The Hon. Dr. Haji Alwi bin Haji Abdul Wahab, The Hon. Tuan Ahmad bin Bache, The Hon. Dato’ Mohd Firuz bin Jaffril, The Hon. Tuan Mohd Nazlan bin Mohd Ghazali and The Hon. Tuan Gabriel Gumis Humen.

    Senior judges presented 6 papers as follows:

    Kursus “Judge Craft and Judgment Writing” telah diadakan diPulau Pinang pada 02-04 Jun 2015 (Selasa hingga Khamis).

    Seramai 16 peserta telah menghadiri kursus ini yang terdiri daripada 6 orang Hakim Mahkamah Tinggi dan 10 orang Pesuruhjaya Kehakiman.     In Judgment Writing, participants were divided into 4 workshop groups to discuss grounds of judgment provided by the facilitators where each group had to then present the result of their discussions at the end of the course.

    This course was divided into 2 main headings, namely, Judge Craft and Judgment Writing. Under the heading Judge Craft, each participant was required to present discussion topics which were pre-determined by the facilitators which was then followed by a discussion.

    In Judgment Writing, participants were divided into 4 workshop groups to discuss grounds of judgment provided by the facilitators where each group had to then present the result of their discussions at the end of the course.

  • Judge Craft and Judgment Writing, 20 - 22 March 2015,

    A course on Judge Craft and Judgment Writing Session 2/2015 was held in Johor Bahru from the 20 - 22 March 2015 (Friday to Sunday).

    A total of 16 participants comprising 10 High Court judges and 6 Judicial Commissioners attended this course. The facilitators were the Rt. Hon.     Kursus “Judge Craft and Judgment Writing” telah diadakan di Johor Bahru pada 20-22 Mac 2015 (Jumaat hingga Ahad).

    Seramai 16 peserta telah menghadiri kursus ini yang terdiri daripada 10 orang Hakim Mahkamah Tinggi dan 6 orang Pesuruhjaya Kehakiman. Di bawah tajuk Judge Craft, peserta dibahagikan kepada 3 kumpulan dan setiap kumpulan dikehendaki membentang tajuk perbincangan sebagaimana ditentukan oleh fasilitator dan kemudian disusuli dengan perbincangan.

    Di bawah tajuk Judgment Writing pula, peserta dibahagikan kepada 4 kumpulan untuk membincangkan alasan penghakiman yang disediakan oleh fasilitator dan setiap kumpulan membentangkan hasil perbincangan tersebut di akhir kursus ini.

    Kursus “Induction Programme for Judicial Commissioners” telah diadakan pada 13-14 April 2015 di Istana Kehakiman, Putrajaya.

  • Visit and Meeting of The Judicial Appointments Commission at The Kota Bharu Court Complex, Kelantan 9 April 2015

    The Judicial Appointments Commission held its monthly meeting No. 4/2015 at the Kota Bharu Court Complex, Kelantan on 9 April 2015. The Commissioners visited several sections of the court such as the Registry of the Sessions / Magistrates Court and the Registry of the High Court as well as attend e-court launching ceremony.

    On 9 April 2015, in conjunction with the Judicial Appointments Commission’s Meeting, a presentation on the Proposed Design Concept for Kota Bharu Court Complex was delivered by YBhg. Datin Noor Haliza binti Mohd Noor, Deputy Director General of Legal Affair Division (BHEUU), Prime Minister’s Department and YBhg. Ir. Prof. Datuk Dr. Amer Hamzah bin Mohd Yunus, Senior Director of General Works Building Division, Public Works Department.

  • Visit and Meeting of The Judicial Appointments Commission at The Seremban Court Complex, Negeri Sembilan 12 August 2015

    The Judicial Appointments Commission held its monthly meeting No. 8 of 2015 in the Main Meeting Room, Seremban Court Complex, Negeri Sembilan on 12 August 2015.

    In addition to the Meeting, the Commissioners also visited several areas of the court complex such as the registry of the High Court, the filing room and the seminar room. The purpose of the visit was to look at the measures taken by the Court in Negeri Sembilan to improve the delivery system to its clients.

    After the visit, the Commissioners were briefed by the Honourable Dato' Zabariah binti Mohd. Yusof, High Court Judge, Seremban and Puan Hayatul Akmal binti Abdul Aziz, Director of the Negeri Sembilan Court, regarding the disposal of both civil and criminal courts throughout the state. YAA Tun Arifin bin Zakaria, Chief Justice as Chairman of the Commission, was satisfied with the achievement of the state court in disposing cases that have been registered and congratulated them on their success. The majority of cases in the Negeri Sembilan Court are current cases, that is, cases registered in 2014 and after. CONGRATULATIONS!

    Prior to the visit and briefings, the Commissioners had an audience with His Majesty the Yang di-Pertuan Besar Negeri Sembilan at the Istana Hinggap in Seremban.
