Objectives

The Appellate Judges' Retreat program aims to strengthen professionalism and judicial integrity at the highest level, and to encourage the exchange of views, critical thinking, and camaraderie among judges through scholarly discussion sessions and relaxed and meaningful networking activities.

Background

This program is specially designed for Federal Court Judges and Court of Appeal Judges.
The session began with opening remarks by YA Dato’ Nordin bin Hassan, Chairman of the Training Committee, Judicial Academy. The main speakers for this program were YA Dato’ Lee Swee Seng, Federal Court Judge, Professor Dr. Joseph Sadek, Professor of Psychiatry at Dalhousie University, and YBrs. Dr. Mohamad Hasni bin Sha’ari, Director of the Monetary Policy Department, Bank Negara Malaysia.
A special closing address was delivered by YAA Tun Tengku Maimun binti Tuan Mat, Chief Justice.

Topics Covered

The program discussed key topics involving issues and challenges faced by superior court judges in performing their duties, with an exchange of views in each discussion session. There were 3 topics presented during the program:

  1. Judicial Wellness
  2. Stare Decisis and Over-Rulling at the Appellate Level by Court of Appeal and Federal Court
  3. Global and Domestic Economic Policy Challenges and Imperatives.

Module/Format

The program was held at Mutiara Taman Negara, Kuala Tahan, Jerantut, Pahang. The program schedule is in Appendix A.

This program was specially designed for Federal Court Judges and Court of Appeal Judges.

The program consisted of 37 participants, and was also attended by YAA Tun Tengku Maimun binti Tuan Mat, Chief Justice, YAA Tan Sri Datuk Amar Abang Iskandar bin Abang Hashim, President of the Court of Appeal, YAA Tan Sri Hasnah binti Dato’ Mohammed Hashim, Chief Judge of Malaya, and YAA Tan Sri Abdul Rahman bin Sebli, Chief Judge of Sabah and Sarawak.


The main speakers for this program were:

  • YA Dato’ Lee Swee Seng, Federal Court Judge, who presented on "Stare Decisis and Over-Ruling at the Appellate Level by Court of Appeal and Federal Court".
  • Professor Dr. Joseph Sadek, Professor of Psychiatry at Dalhousie University, who discussed "Judicial Wellness";
    (Online).
  • YBrs. Dr. Mohamad Hasni bin Sha’ari, Director of the Monetary Policy Department, Bank Negara Malaysia, who provided an explanation related to "Global and Domestic Economic Policy Challenges and Imperatives";.

Participation

The total number of participants was 37 Judges (10 from the Federal Court and 27 from the Court of Appeal).
