  • Good Faith in Contractual Performance

    Seminar “Good Faith in Contractual Performance” telah diadakan pada 27 Ogos 2021 (Jumaat) di Bilik Mesyuarat Utama, Suruhanjaya Pelantikan Kehakiman, Istana Kehakiman, Putrajaya. Objektif seminar ini adalah untuk menyediakan peserta-peserta dengan pemahaman yang lebih baik mengenai perspektif dan aplikasi konsep Good Faith di Malaysia. Program ini adalah program kedua di bawah Akademi Kehakiman Malaysia pada tahun 2021 dan yang pertama dilaksanakan secara atas talian menggunakan aplikasi Zoom Meeting dengan kerjasama Pejabat Ketua Pendaftar Mahkamah Persekutuan Malaysia bagi jemputan peserta Hakim Mahkamah Seksyen dan Timbalan Pendaftar seluruh Malaysia. Pelaksanaan program secara atas talian ini telah dilaksanakan dengan mematuhi Perintah Kawalan Pergerakan (PKP) 3.0 iaitu bagi mengawal penularan pandemik COVID-19.

    Seramai 159 orang peserta berdaftar yang terdiri daripada 6 orang Hakim Mahkamah Persekutuan, 7 Hakim Mahkamah Rayuan, 27 orang Hakim Mahkamah Tinggi, 39 orang Pesuruhjaya Kehakiman, 41 orang Hakim Mahkamah Seksyen, dan 39 orang Timbalan Pendaftar/Pegawai Khas/Pegawai Penyelidik telah menghadiri program ini secara atas talian. Manakala seramai 115 orang Timbalan Pendaftar/Pegawai khas/Pegawai Penyelidik yang tidak berdaftar telah turut menghadiri program ini secara atas talian.
    Program selama separuh hari ini dimulakan dengan ucapan alu-aluan oleh YA Datuk Seri Haji Mohd Zawawi bin Salleh, Hakim Mahkamah Persekutuan merangkap Pengerusi Jawatankuasa Latihan, Akademi Kehakiman. Program kemudian diteruskan oleh sesi pengenalan oleh YA Datuk See Mee Chun, Hakim Mahkamah Rayuan yang bertindak sebagai moderator sebelum YBrs. Dr. Nurhidayah binti Abdullah, Pensyarah Kanan dari Jabatan Pengajian Pentadbiran dan Politik, Fakulti Ekonomi dan Pentadbiran, Universiti Malaya memulakan ceramah beliau yang bertajuk “Good Faith in Contractual Performance”. Sesi ceramah tersebut telah diakhiri dengan sesi soal-jawab dan penilaian kursus secara atas talian oleh para peserta program.

  • Good Faith in Contractual Performance

    The “Good Faith in Contractual Performance” Seminar was held on 27th August 2021 (Friday) at the Main Meeting Room, Judicial Appointments Commission, Palace of Justice, Putrajaya. The seminar aimed to provide a better understanding on the perspective and future of Good Faith in Contractual Performance in Malaysia. This was the second programme under the Judicial Academy Malaysia in 2021 and the first to be conducted online via Zoom Meeting application in collaboration with the Office of the Chief Registrar Federal Court of Malaysia attended by the Section Court Judges and Deputy Registrars throughout Malaysia. The online programme was conducted in compliance with the Movement Control Order (MCO) 3.0 to curb the spread of the COVID-19 virus.

    A total of 159 registered participants consisting of six Federal Court Judges, seven Judges of the Court of Appeal, 27 High Court Judges, 39 Judicial Commissioners, 41 Section Court Judges, and 39 Deputy Registrars/ Special Officers/Research Officers attended this programme. Meanwhile, 115 Deputy Registrars/ Special Officers/Research Officers who were not registered had also attended the programme.

    The half-day programme began with the welcoming remarks by The Honourable Datuk Seri Haji Mohd Zawawi bin Salleh, Federal Court Judge cum the Chairman of Training Committee of Judicial Academy Malaysia. The programme was then continued with an introductory session by The Honourable Datuk See Mee Chun, Judge of the Court of Appeal, who acted as a moderator before Dr Nurhidayah Binti Abdullah, a Senior Lecturer from the Department of Administrative Studies and Politics, Faculty of Economics and Administration, University of Malaya. The Honourable Datuk See Mee Chun started the talk on “Good Faith in Contractual Performance”. The talk ended with a question-and-answer session and an online course assessment of the participants.

  • Induction Programme for Judicial Commissioners 29th March-1st April 2021

    "Induction Programme for Judicial Commissioners" was held on 29th March-1st April 2021 (Monday-Thursday) at the Secretary's Office, Judicial Appointments Commission, Palace of Justice, Putrajaya. This programme aimed to expose the participants to the scope and areas of work and best practices that must be adhered to when fulfilling their duties and responsibilities as Judicial Commissioners. This programme was the first activity organized by the Judicial Academy in 2021 during the Recovery Movement Control Order (RMCO) due to the COVID-19 pandemic.

    A total of 10 candidates of Judicial Commissioners attended this course, including Puan Amelati Anak Parnell, Puan Norliza binti Othman, Tuan Hasbullah bin Adam, YBhg. Dato' Sri Shamsulbahri bin Haji Ibrahim, Tuan Roslan bin Mat Nor, Puan Julia Binti Ibrahim, YBhg. Datuk Mohamad Abazafree bin Mohd Abbas, YBhg. Dato' Mohd Arief Emran bin Arifin, YBrs. Dr. John Lee Kien How@Mohd Johan Lee, dan Puan Adlin binti Abdul Majid.

    The course began with a speech delivered by The Right Honourable Tun Tengku Maimun Binti Tuan Mat, Chief Justice of Malaysia, followed by a course briefing by The Honourable Datuk Seri Haji Mohd Zawawi bin Salleh, the Federal Court Judge and the Chairman of the Training Committee, Malaysian Judicial Academy. This four-day course was conducted in lectures and was followed by a question and answer session. A total of 10 topics were presented by senior judges entitled "Joint Session with Chief Judge of Malaya and Chief Judge of Sabah and Sarawak"; "Salient Features of the Rules of Court 2012"; "Judgement Writing Workshop"; "Case Management in Civil Cases and Court-Annexed Mediation"; "How to Conduct Criminal Trials and Appeals/Revisions in the High Court"; "Managing Procrastination and Competing Priorities"; "When to Recuse"; "Contempt Proceedings"; "How to Read Statutes"; dan "Judicial Power Under the Federal Constitution". Lectures entitled "e-Court System and e-Review"; and "Salary, Allowance and Benefits for Judges" were presented by officers from the Office of the General Registrar of the Federal Court of Malaysia. The Right Honourable Tun Tengku Maimun Binti Tuan Mat, Chief Justice of Malaysia, had presented certificates to the participants who will be appointed as Judicial Commissioner at the end of the course.

  • International Trademark Association’s Workshop

    Program “International Trademark Association’s Workshop” telah diadakan pada 26 November 2021 (Jumaat) di Dewan Bankuet, Istana Kehakiman, Putrajaya. Objektif kursus ini adalah untuk memberikan peserta-peserta pemahaman yang komprehensif mengenai isu-isu yang berkaitan dengan undang-undang tanda dagangan. Program ini merupakan program latihan kelima di bawah Akademi Kehakiman Malaysia pada tahun 2021 dan yang keempat dilaksanakan secara atas talian menggunakan aplikasi Zoom Meeting. Pelaksanaan program yang dilakukan secara atas talian ini adalah untuk mematuhi Prosedur Operasi Standard (SOP) bagi mengawal penularan pandemik COVID-19 dengan semua penceramah dan para peserta telah hadir secara atas talian.

    Program selama separuh hari ini dimulakan dengan ucapan pembukaan oleh YAA Tun Tengku Maimun binti Tuan Mat, Ketua Hakim Negara; Iris Gunther, Pengarah Penguatkuasaan Jenama dan Kemampanan, Persatuan Tanda Dagangan Antarabangsa (INTA); dan Seth Hays, Ketua Perwakilan Pejabat Asia Pasifik, Persatuan Tanda Dagangan Antarabangsa (INTA). Program kemudian diteruskan dengan bengkel yang telah dibahagikan kepada tiga sesi. Sesi pertama telah dikendalikan oleh YA Datuk Wong Kian Kheong, Hakim Mahkamah Tinggi yang telah bertindak sebagai moderator untuk sesi yang bertajuk “An Overview Over TMA 2019 – Changes to Malaysian TM Law and The International Perspective” yang telah disampaikan oleh Prof. Madya Rohazar Wati binti Zuallcobley daripada Fakulti Undang-Undang, Universiti Teknologi MARA; dan Juan Rodriguez Guerra, Kaunselor Undang-Undang Kanan, Bahagian Undang-Undang Pendaftaran Madrid di Pertubuhan Harta Intelek Dunia (WIPO), Switzerland. Manakala tajuk sesi kedua “Select Changes to The TMA in Comparison with Other Jurisdictions” telah disampaikan oleh Maxim Hristov, Peguam Undang-Undang, PETOSEVIC Bulgaria; dan Bob Kelson, Pengetua, Perundingan Paten dan Tanda Dagangan BK, Australia dengan YA Dato’ Mohd Radzi bin Harun, Hakim Mahkamah Tinggi sebagai moderator. YA Datuk Hanipah binti Farikullah, Hakim Mahkamah Rayuan telah mengendalikan sesi ketiga sebagai moderator untuk tajuk “Enforcement of IPR Against Online Violation” yang telah disampaikan oleh Andrej Stec, Penasihat, Mahkamah Agung Kesatuan Eropeah di Luxembourg; dan Cecilia Dou, Pengurus Penguatkuasaan IP Dalam Talian, Syarikat Apple China.

  • International Trademark Association’s Workshop

    The “International Trademark Association’s Workshop” Programme was held on 26th November 2021 (Friday) at the Banquet Hall, Palace of Justice, Putrajaya. The objective of this programme was to provide participants with a comprehensive understanding of the issues related to trademark law. This programme was the fifth under the Judicial Academy Malaysia in 2021 and the fourth to be conducted online using the Zoom Meeting application. The implementation of this online programme was to comply with the Standard Operating Procedures (SOP) to control the spread of the COVID-19 pandemic with all the speakers and participants who attended online.


    The half-day programme began with an opening address by The Right Honourable Tun Tengku Maimun Binti Tuan Mat, Chief Justice of Federal Court, Malaysia; Iris Gunther, Director Brand Enforcement and Sustainability, International Trademark Association (INTA); and Seth Hays, Chief Representative Asia Pacific Office, International Trademark Association (INTA). The programme then continued with a workshop that was divided into three sessions. The Honourable Datuk Wong Kian Kheong High Court Judge conducted the first session as moderator for the “An Overview Over TMA 2019 – Changes to Malaysian TM Law and The International Perspective” session. He represented Assoc. Prof. Rohazar Wati Binti Zuallcobley from Faculty of Law, MARA University of Technology and Juan Rodriguez Guerra, Senior Legal Counsellor, Legal Divison of The Madrid Registry at The World Intellectual Property Organization (WIPO), Switzerland. While the second session, “Select Changes to The TMA in Comparison with Other Jurisdictions”, was presented by Maxim Hristov, Attorney at Law, PETOSEVIC Bulgaria; and Bob Kelson, Principal, BK Patent and Trademark Consultation, Australia, with The Honourable Dato’ Mohd Radzi bin Harun, High Court Judge as moderator. The Honourable Datuk Hanipah Binti Farikullah, Judge of Court of Appeal, conducted the third session as moderator for the title “Enforcement of IPR Against Online Violation”, which was presented by Andrej Stec, Advisor (Referendaire), General Court European Union in Luxembourg; and Cecilia Dou, Online IP Enforcement Manager, Apple Inc. China.

  • Program Induksi Pesuruhjaya Kehakiman 29 Mac -1 April 2021

    “Program Induksi Pesuruhjaya Kehakiman” telah diadakan pada 29 Mac-1 April 2021 (Isnin-Khamis) di Pejabat Setiausaha, Suruhanjaya Pelantikan Kehakiman, Istana Kehakiman, Putrajaya. Objektif program ini adalah untuk memberi pendedahan kepada peserta-peserta akan skop dan bidang-bidang tugas serta amalan-amalan terbaik (best practices) yang mesti diikuti ketika menggalas tugas dan tanggungjawab sebagai Pesuruhjaya Kehakiman. Kursus ini adalah kursus pertama anjuran Akademi Kehakiman yang diadakan pada tahun 2021 dalam norma baharu Perintah Kawalan Pergerakan Pemulihan (PKPP) iaitu ketika negara sedang berhadapan dengan pandemik COVID-19.

    Seramai 10 orang calon yang akan dilantik sebagai Pesuruhjaya Kehakiman telah menghadiri kursus ini iaitu Puan Amelati Anak Parnell, Puan Norliza binti Othman, Tuan Hasbullah bin Adam, YBhg.   • Section 39B of the Dangerous Drugs Act 1952

    Kursus “Section 39B of the Dangerous Drugs Act 1952” telah diadakan pada 24-25 September 2021 (Jumaat-Sabtu) di Dewan Bankuet, Istana Kehakiman, Putrajaya. Objektif kursus ini adalah untuk memberi pemahaman menyeluruh berkenaan aspek undang-undang Seksyen 39B Akta Dadah Berbahaya 1952. Program ini merupakan program latihan ketiga di bawah Akademi Kehakiman Malaysia pada tahun 2021 dan yang kedua dilaksanakan secara atas talian menggunakan aplikasi Zoom Meeting. Pelaksanaan program ini dilakukan dengan mematuhi Prosedur Operasi Standard (SOP) bagi mengawal penularan pandemik COVID-19. Program ini telah dilaksanakan secara hibrid iaitu panel penceramah bersiaran secara fizikal di Dewan Bankuet manakala para peserta hadir secara atas talian.

    Seramai 70 orang peserta yang terdiri daripada 4 orang Hakim Mahkamah Persekutuan, 31 orang Hakim Mahkamah Tinggi, 33 orang Pesuruhjaya Kehakiman, dan 2 orang Timbalan Pendaftar/Pegawai Khas/Pegawai Penyelidik telah menghadiri program ini.

    Program selama 1 hari setengah ini dimulakan pada hari pertama dengan ucapan pembukaan oleh YAA Tun Tengku Maimun binti Tuan Mat, Ketua Hakim Negara. Program kemudian diteruskan dengan 2 ceramah pada sesi pagi iaitu “Duty of Trial Judge at the End of the Case for Prosecution” yang disampaikan oleh YA Dato’ Abdul Rahman bin Sebli, Hakim Mahkamah Persekutuan dan “Duty of Trial Judge at the Conclusion of the Trial” yang disampaikan oleh YAA Tan Sri Dato’ Sri Azahar bin Mohamed, Hakim Besar Malaya. Ceramah “Common Mistake Made by Trial Judge in Adjudicating Section 39B Cases” disampaikan pada sesi petang oleh YA Datuk Seri Haji Mohd. Zawawi bin Salleh, Hakim Mahkamah Persekutuan merangkap Pengerusi Jawatankuasa Latihan, Akademi Kehakiman Malaysia; YA Datuk Yaacob bin Haji Md.   • Section 39B of the Dangerous Drugs Act 1952

    The “Section 39B of the Dangerous Drugs Act 1952” Course was held on 24th-25th September 2021 (Friday-Saturday) at the Banquet Hall, Palace of Justice, Putrajaya. The seminar aimed at providing Judges/Judicial Commissioners with a comprehensive understanding of certain aspects of the law of Section 39B of the Dangerous Drugs Act 1952. This was the third programme under the Judicial Academy Malaysia in 2021 and the second to be conducted online via the Zoom Meeting application. The programme has been conducted in compliance with the Standard Operating Procedures (SOP) to control the spread of the COVID-19 virus.

    A total of 70 participants consisting of four Federal Court Judges, 31 High Court Judges, 33 Judicial Commissioners, and 2 Deputy Registrars/Special Officers/Research Officers attended this programme.

    The one and a half-day programme began on the first day with an opening by The Right Honourable Tun Tengku Maimun Binti Tuan Mat, Chief Justice of Federal Court, Malaysia. The programme was then continued with two talks in the morning session on “Duty of Trial Judge at the End of the Case for Prosecution” by The Honourable Dato’ Abdul Rahman bin Sebli, Federal Court Judge and “Duty of Trial Judge after the Trial” by The Right Honourable Tan Sri Dato’ Sri Azahar bin Mohamed, Chief Judge of the High Court in Malaya. The talk on “Common Mistakes Made by Trial Judge in Adjudicating Section 39B Cases” was delivered in the afternoon session by The Honourable Datuk Seri Haji Mohd. Zawawi bin Salleh, Federal Court Judge cum Chairman of the Training Committee of the Judicial Academy Malaysia; The Honourable Datuk Yaacob bin Haji Md. Sam, Judge of the Court of Appeal; and The Honourable Datuk Abdul Karim bin Abdul Jalil, Judge of the Court of Appeal.

    A total of four Presentations and Discussions on Specific Topics by Participants were presented on the second day with The Honourable Dato’ Nordin bin Hassan, Judge of the Court of Appeal acted as the moderator. The topics were “The Defence of Innocent Carrier” by The Honourable Tuan Mohamed Zaini bin Mazlan, High Court Judge; “Alcontara Notice” by The Honourable Dato’ Abd. Wahab bin Mohamed, High Court Judge; and “Problems Faced by Trial Judges in Conducting Criminal Trial” by 2 Judicial Commissioners, namely The Honourable Dr Shahnaz Binti Sulaiman and The Honourable Puan Nurulhuda Nur’aini Binti Mohamed Nor.

  • Talk on Ouster Clause: The UK Experience by Prof. Emeritus Carol Harlow QC (Hon)

    Program “Talk on Ouster Clause: The UK Experience by Prof. Emeritus Carol Harlow QC (Hon)” telah diadakan pada 29 Oktober 2021 (Jumaat) di Dewan Bankuet, Istana Kehakiman, Putrajaya. Objektif kursus ini adalah untuk memberi pemahaman menyeluruh berkenaan pengalaman negara United Kingdom ke atas Ouster Clause. Program ini merupakan program latihan keempat di bawah Akademi Kehakiman Malaysia pada tahun 2021 dan yang ketiga dilaksanakan secara atas talian menggunakan aplikasi Zoom Meeting. Pelaksanaan program yang dilakukan secara atas talian ini adalah untuk mematuhi Prosedur Operasi Standard (SOP) bagi mengawal penularan pandemik COVID-19. Program ini telah dilaksanakan secara hibrid iaitu penceramah dan para peserta hadir secara atas talian.

    Seramai 112 orang peserta yang terdiri daripada 6 orang Hakim Mahkamah Persekutuan, 13 Hakim Mahkamah Rayuan, 30 orang Hakim Mahkamah Tinggi, 36 orang Pesuruhjaya Kehakiman, dan 27 orang Timbalan Pendaftar/Penolong Kanan Pendaftar/Pegawai Khas/Pegawai Penyelidik/Pegawai Undang-Undang telah menghadiri program ini.

    Program selama separuh hari ini dimulakan dengan ucapan pembukaan oleh YAA Tun Tengku Maimun binti Tuan Mat, Ketua Hakim Negara. Program kemudian diteruskan oleh sesi pengenalan oleh YA Datuk Hajah Azizah binti Haji Nawawi, Hakim Mahkamah Rayuan yang bertindak sebagai moderator sebelum Prof. Emeritus Carol Harlow QC (Hon), pensyarah undang-undang di London School of Economics (LSE) memulakan ceramah beliau. Sesi ceramah tersebut telah diakhiri dengan sesi soal-jawab dan penilaian kursus secara atas talian oleh para peserta program.

  • Talk on Ouster Clause: The UK Experience by Prof. Emeritus Carol Harlow QC (Hon)

    The “Talk on Ouster Clause: The UK Experience by Prof. Emeritus Carol Harlow QC (Hon)” Programme was held on 29th October 2021 (Friday) at the Banquet Hall, Palace of Justice, Putrajaya. The programme aimed at providing a comprehensive understanding of the United Kingdom’s experience on the Ouster Clause. This was the fourth programme conducted under the Judicial Academy Malaysia in 2021, and the third was conducted online via the Zoom Meeting application in compliance with the Standard Operating Procedures (SOP) to control the spread of the COVID-19 pandemic.

    A total of 111 participants consisting of six Federal Courts Judges, 13 Judges of the Court of Appeal, 30 High Court Judges, 36 Judicial Commissioners, and 27 Deputy Registrars/Senior Assistant Registrars/Special Officers/Research Officers/Legal Officers had attended this programme.

    The half-day programme began with an opening address by The Right Honourable Tun Tengku Maimun Binti Tuan Mat, Chief Justice of Federal Court, Malaysia. The programme was then continued with an introductory session by The Honourable Datuk Hajah Azizah Binti Haji Nawawi, Judge of the Court of Appeal who acted as a moderator before Prof. Emeritus Carol Harlow QC (Hon), a law lecturer at the London School of Economics (LSE) began her talk. The talk session ended with a question-and-answer session and online course assessment.
