  • Induction Programme for Judicial Commissioners, 7th-10th February 2023

    "Induction Programme for Judicial Commissioners" was held on 7th-10th February 2023 (Tuesday-Friday) at the Conference Hall, Palace of Justice, Putrajaya. This programme aimed to expose the participants to the scope and areas of work and best practices that must be adhered to when fulfilling their duties and responsibilities as Judicial Commissioners.

    A total of 13 candidates who have been and will appointed as Judicial Commissioners attended this course, including The Honourable Puan Roz Mawar binti Rozain, The Honourable Puan Fathiyah binti Idris, The Honourable Puan Wan Fadhilah Nor binti Wan Idris, The Honourable Puan Rofiah binti Mohamad, The Honourable Puan Wong Mee Ling, The Honourable Dato’ Raja Mohzanuddin Shah bin Raja Mohzan, The Honourable Tuan Suria Kumar a/l Durairaj Johnson Paul, The Honourable Puan Zaharah binti Hussain, The Honourable Puan Sumathi a/p Murugiah, The Honourable Dr. Suzana binti Muhamad Said, The Honourable Puan Evawani Farisyta binti Mohammad, The Honourable Dr. Wendy Ooi Su Ghee, and YBrs.     The course began with a speech delivered by The Right Honourable Tun Tengku Maimun binti Tuan Mat, Chief Justice of Malaysia, followed by a course briefing by The Honourable Datuk Vernon Ong Lam Kiat, the Federal Court Judge and the Chairman of the Training Committee, Judicial Academy Malaysia. This four-day course was conducted in lectures and was followed by a question and answer session. A total of 12 topics were presented by senior judges entitled “Judges’ Code of Ethics”, “Joint Session with Chief Judge of Malaya and Chief Judge of Sabah and Sarawak”, “Conducting Civil Cases – Challenges and Pitfalls”, “Virtual Hearings”, “Contempt Proceedings”, “Case Management - Civil and Criminal, Court Annexed Mediation”, “When to Recuse”, “Criminal Trials and Applications”, “Reading Statutes”, “Managing Judicial Review and Family Cases”, “Judgment Writing Workshop: Issues Based Approach in Judgment Writing”, and “Judgment Writing Workshop: Challenges in Judgment Writing”. Lectures entitled "e-Court System and e-Review", and "Salaries, Allowances and Benefits of Judges" were presented by officers from the Office of the Chief Registrar, Federal Court of Malaysia. The Right Honourable Tun Tengku Maimun binti Tuan Mat, Chief Justice of Malaysia, had presented certificates to the participants after the course ended.

  • Judicial Workshop on Intellectual Property Law and Practice: Emerging Issues on Trademark Law, 26th October 2023

    The “Judicial Workshop on Intellectual Property Law and Practice: Emerging Issues on Trademark Law” was held on 26th October 2023 (Thursday) at the Banquet Hall, Palace of Justice, Putrajaya. The objective of this programme was to provide participants with a comprehensive understanding on the issues related to trademark law. This programme has been implemented in a hybrid manner where some participants have attended physically while most of other participants have attended online. This programme was organized in collaboration between the Malaysian Judicial Academy and the International Trademark Association (INTA).

    The one-day programme began with an opening address by The Honourable Dato’ Sri Hasnah binti Dato’ Mohammed Hashim, Federal Court Judge cum the Chairman of the Training Committee of Malaysian Judicial Academy. The programme then continued with the first session conducted by The Honourable Tuan Mohamed Zaini bin Mazlan, Judge of the Court of Appeal as moderator for the talk “Emerging Technologies and IP: AI, NFTs, Block Chain and its Relevance for an Impact on IPR” which was presented by Dr. Stanley Lai from SC: Allen & Gledhill; and Mr. Bahari Yeow from RDS Law Partners. The second session continued with the talk “Bad Faith in Trademark Cases: Prosecution, Judicial Proceedings, Online Implications: INTA’s Board Resolution” which was presented by Ms. Iris Gunther, Director Brand Enforcement and Sustainability, INTA; and Mr. Nick Redfearn, Principal, Global Head of Enforcement, Rouse- Jakarta. The Honourable Tuan Azlan bin Sulaiman, Judicial Commisioner conducted third session as moderator for the talk “Case Discussion Bad Faith: Triple D Trading Pte. Ltd. v. Fanco Fan Marketing Pte. Ltd.” which was presented by The Honourable Justice Dedar Singh Gill, High Court Judge, Supreme Court of Singapore. The fourth session was moderated by The Honourable Dato’ Dr. Choo Kah Sing, Judge of the Court of Appeal for talk “IP Enforcement – Dynamic Blocking Injuctions – Process, Requirements, Case Examples” presented by Dr. Nicolas Schmitz, Gruneker, Munich Law Firm, Germany; and The Honourable Justice Manmohan, Delhi High Court Judge. While the fifth and last session with the talk “Bad Faith International Comparison (Sky v. SkyKick)” was presented by The Honourable Lord Justice Richard Arnold, Judge of the Court of Appeal of England and Wales with The Honourable Dato’ Mohd Nazlan bin Mohd Ghazali, Judge of the Court of Appeal acted as moderator.

  • Meeting of The Judicial Appointments Commission and Opening of The Legal Year of Sabah and Sarawak 2023 at Miri, Sarawak

    The 1st Meeting of Judicial Appointments Commission was held on 13th January 2023 (Friday) at Waterfront 2, Level 6, Pullman Miri Waterfront, Sarawak. This meeting was the first monthly meeting which was held outside from Putrajaya in 2023. This meeting was held in conjunction with the "Opening of the Legal Year of Sabah and Sarawak 2023" which was held in the morning on the same day at the Miri Courts Complex, Sarawak. A parade that started from the Pullman Miri Waterfront, Sarawak and ended at the Miri Courts Complex, Sarawak was held in conjunction with the "Opening of the Legal Year of Sabah and Sarawak 2023". The parade was led by The Right Honourable Tun Tengku Maimun binti Tuan Mat, Chief Justice of Federal Court; The Right Honourable Tan Sri Datuk Amar Abang Iskandar bin Abang Hashim, Chief Judge of the High Court in Sabah and Sarawak; The Honourable Dato’ Mohamad Zabidin bin Mohd Diah, Federal Court Judge; and The Honourable Dato’ Abdul Rahman bin Sebli, Federal Court Judge.

  • Section 302 of the Penal Code 1/2023, 30th May 2023

    The course of “Section 302 of the Penal Code 1/2023” was held in the Conference Hall, Palace of Justice, Putrajaya on 30th May 2023 (Tuesday). The objective of this course was towards a better understanding of Section 302 of the Penal Code.

    A total number of 25 participants had attended the course, consisting of 20 Judges of the High Court and five Judicial Commissioners. This course was also attended by The Honourable Dato’ Sri Hasnah binti Dato’ Mohammed Hashim, Federal Court Judge cum Chairman of the Training Commitee, Judicial Academy, and The Honourable Dato’ Mary Lim Thiam Suan, Federal Court Judge cum Member of the Training Commitee, Judicial Academy. Facilitators, who assisted the course were The Honourable Dato’ Nordin bin Hassan, Federal Court Judge, and The Honourable Datuk Abdul Karim bin Abdul Jalil, Judge of the Court of Appeal.

    Five discussion topics were presented in this course, namely “The Offence of Murder and The Offence of Culpable Homicide Not Amounting to Murder Under The Penal Code – Concept and Elements of The Offences”, “Sections 34 and 149 of The Penal Code”, “Evidence of Forensic Pathologist”, “Witnesses”, and “Corroboration”. Each presentation took one hour including discussion time among participants, and facilitators.

  • Section 302 of the Penal Code 2/2023, 8th September 2023

    The course of “Section 302 of the Penal Code 2/2023” was held in the Conference Hall, Palace of Justice, Putrajaya on 8th September 2023 (Friday). The objective of this course was towards a better understanding of Section 302 of the Penal Code.

    A total number of 29 participants had attended the course, consisting of five Judges of the Court of Appeal, 22 Judges of the High Court, and two Judicial Commissioners. This course was also attended by The Honourable Dato’ Sri Hasnah binti Dato’ Mohammed Hashim, Federal Court Judge cum Chairman of the Training Commitee, Judicial Academy; and The Honourable Dato’ Mary Lim Thiam Suan, Federal Court Judge cum Member of the Training Commitee, Judicial Academy. Facilitators consisting of three Federal Court Judges have assisted the course namely The Honourable Dato’ Nordin bin Hassan, The Honourable Dato’ Abu Bakar bin Jais, and The Honourable Datuk Abdul Karim bin Abdul Jalil.

    The participants were divided into four groups with a membership of seven or eight people per group. Each group was required to discuss specific topics related to this course and then presented the results of the discussion. The topics of the discussion are “The Offence of Murder and the Offence of Culpable Homicide Not Amounting to Murder Under the Penal Code – Concept and Elements of The Offences”, “Distinguishing Features and Application of Sections 34 and 149 of the Penal Code”, “The Defence of Insanity Under Section 84 of the Penal Code”, and “Treatment of Expert and Corroborative Evidence”.

  • The 7th Meeting of Judicial Appointments Commission, 12th June 2023

    The 7th Meeting of Judicial Appointments Commission was held on the morning of 12th June 2023 (Monday) at Shangri-La Rasa Ria Hotel, Kota Kinabalu, Sabah. The meeting started with Performance and Statistics Reports of Sabah High Court, and Performance and Statistics Reports of Sabah Lower Court. The programme was then followed by a meeting session.

    After the meeting, the programme continued with a visit to the Tuaran Court which was not far from where the meeting was held. The visit took approximately an hour. Members of the Commission then after lunch departed to Sabah Bajausama Cultural Centre for the purpose of the Outreach Programme. Members of the Commission were introduced to Sabah Bajausama ethnic culture during the Outreach Programme.

  • The Judicial Appointments Commission Meeting and Visit to the Pulau Pinang State Court

    This one-day programme started on the morning of 28th July 2023 (Friday) with a visit by members of the Judicial Appointments Commission led by The Right Honourable Tun Tengku Maimun binti Tuan Mat, Chief Justice of Federal Court, Malaysia cum Chairman of the Judicial Appointments Commission to the Pulau Pinang State Court Heritage Building. Statistics Reports of Pulau Pinang High Court and Statistics Reports of Pulau Pinang Lower Court were presented as part of the visit. Meanwhile, the Meeting of Judicial Appointments Commission No. 8/2023 was held in the afternoon at Shangri-La Rasa Sayang Resort & Spa Pulau Pinang. Court of Appeal statistics were presented in the meeting by Puan Jumirah binti Marjuki, Registrar of the Court of Appeal.

  • Writing Better Judgments 1/2023, 9th - 11th March 2023

    The “Writing Better Judgments 1/2023” Course was held on 9th - 11th March 2023 (Thursday-Saturday) at The Saujana Hotel Kuala Lumpur. The course objective was to introduce the concepts which aim to improve ability as a writer of judgments to write reasons that are clear, concise, comprehensive, coherent and convincing (‘5Cs’).

    This three-day course consisted of 11 sessions namely “Why Good Judgments Matter?”, “Issues Based Approach to Judgment Writing: The Conceptual Framework”, “The First Page and Creating Headings”, “First Breakout Group Session: Individual Feedback Session and Exercise on Re-writing the First Page and Creating Headings”, “Challenges of Judgment Writing” / “The Structural Construct of an Issues Based Judgment”, “The Road to Judgment”, “Workshop on Practical Issue Identification”, “Second Breakout Group Session: Workshop – Review of the Re-written First Page and List of Headings”, “Issues Based Approach Judgment Writing in Criminal Cases (Section 39B of The Dangerous Drugs Act 1952)”, “Managing Procrastination and Competing Priorities” and “Third Breakout Group Session: Workshop – Review of The Re-written Submitted Judgment”.

    Each participant was given a task to rewrite a sample of judgment ground based on the suggested principles in this course and then submitted the judgement to the facilitators of their respective groups. The participants were divided into four groups consisting of six members per group. The participants of each group were guided by three facilitators who are Judges from Federal Court and the Court of Appeal.

    A total of 24 participants consisting of six High Court Judges and 18 Judicial Commissioners participated in the course.
